Wife given OK by Britain Supreme Court to sue her newly rich ex-husband 25 years after the divorce * 1
    #21401486 -

So basically, they divorced. Then from there the husband started a green energy company and became a multimillionaire.

25 years later. The wife sues him for divorce money.

Is that fair?

Quote:
LONDON - Britain's Supreme Court ruled Wednesday that the passage of time is no barrier to a financial settlement in a divorce case, giving a British woman the right to pursue a claim against her ex-husband decades after they parted ways.

In a landmark ruling, the court decided that Kathleen Wyatt, 55, was entitled to seek compensation from ex-husband Dale Vince, 53. The couple married in 1981, raised two children together and lived a lifestyle of New Age nomads. When they divorced in 1992, they had no assets or income.

After the split, their lives diverged dramatically.

Wyatt struggled, raising a daughter from a previous relationship and a son she had with Vince, while her ex-husband went on to establish Ecotricity, a green energy company and windmill builder valued by the court at some 57 million pounds ($85 million.)

Though files going back years could not be located, the Supreme Court said there was no reason to believe Wyatt had previously sought financial provision and had her claims dismissed — effectively deciding she still deserved her day in court.

Another court will now decide what amount Wyatt will receive.

She has sought 1.9 million pounds ($2.9 million). Justice Nicholas Wilson said that was "out of the question" but that she might get enough to buy a mortgage-free house.

Wyatt described the decision as "important" but Vince called it "mad."

"I feel that we all have a right to move on and not be looking over our shoulders," he said. "This could signal open season for people who had brief relationships a quarter of a century ago,"

William Healing, a family law partner at Kingsley Napley LLP, said the case showed that couples should tie up loose ends upon separation with a formal court order.

"It is the childcare responsibilities she had which have kept her claim alive over two decades," Healing said in a statement. "That fact alone gives her a good chance of getting, say, (a) roof over head, from her ex-husband's millions."

Should the wife be able to sur for her husband money 25 years after the divorce?

Alright. I though I was the only one that felt this was wrong. It seemed too obvious to be true in my head so I figured I might have misunderstood something...

It's fucked up IMO too.Having an ex of 25 years come after your hard earned fortune which she hasn't helped you gained in no wy is in fact extremely fucked up.

BUT!!!

I have to say. If the guy was cheap enough to tolerate that his kids lived in poverty with their mom and not think of helping out just a little. He's an asshole. But not enough to get sued 25 years later for it.

I'm not 100% on whether the article means she was given the green light to have her day in court, or if the idea of suing the guy is OK and now they're just trying to figure out how much she gets.
If it's the latter, then the UK legal system is fucked up for allowing this thing.

I think it's fair. That woman probably could've at least gotten a house if she only had the one kid instead of the two. One of the kids is his. If he can levy a finacial burden against her, she can against him. It's a legitimate argument. The only way his side gains any strength if he argues that she already had a kid and there for his was just one more. Which obviously is a bull shit arguement. But yea, kids are expensive, fuck him I'd sue him and I'm a dude.

I could (kinda) understand him having to pay back child support (depending on the childs age) but anything more is ridiculous.

Money IS power.
As a multimillionaire I'd hire a hit man to make her dissappear. Then pay off anybody investigating to close the case. You can do a lot of things with money just need enough of it then people will turn evil, money is the motive behind all evil.

I believe under US Law she'd only be able to sue for money he had while they were married and child support money.
