Illinois marijuana laws

okay, im at court all the time and i'm always looking up laws on the books. illinois marijuana laws specifically state that the plant canabis sativa is illegal. all references made to canabis in the books use the language canabis sativa.
this would lead me to believe that a suitable defense for the posesion or sale of canabis, is that the canabis is not canabis sativa rather canabis indica.
does anyone have any input on this? specifically if canabis sativa and canabis indica can be considered 2 different plants?

there is only one species, and it is Cannabis sativa. 'indica' not a species name, but a different cultivar\variety\strain\whatever.

the full botanical names of the two varieties are:

Cannabis sativa var. Sativa

and

Cannabis sativa var. Indica

In either Indoor Marijuana Hulticutre (Jorge Cervantes) or the book by Ed Rosenthal (I forget which) they explain that the federal government does not see marijuana as coming from three distinct cannabis varieties, the c. sativa, c. indica and c. ruderalis plants that most potheads and hemp growers recognize. Thus, any "marijuana" you have is, in the gov'ts eyes, cannabis sativa.

There is no common consenus among taxonomists whether or not sativa and indica are different species or variations of the same species. It's kind of arbititrary as of the difference between a species and a variation,especially in botany.

My interests lie mainly in pharmacology on the subject so I'm not all that current on botany,but everything I've ever seen detailing this subject states what I've just said.

Maybe there are some laws now that differentiates between species based on DNA that I'm not aware of. Can everybody point me to a link that supports the fact that they are variations?

they interbreed to produce viable offspring. this means that they are of the same species.

there are very rare cases where genetically similar, morphologically identical, sexually-compatible populations will be classified as different species. this is done when because of environmental conditions, the two have no chance of interbreeding in the wild. there's some type of toad they do this with. they're really the same animal, but because of where their environment, their populations never mix, and they are considered 2 different species. even at that, there are biologists who disagree with this classification.

type "cannabis sativa var. indica" in a search engine and you will get a hell of alot of hits.

zippoz.. the gov't will nail you for the indica variety just the same as the would for the sativa...

so i could put a taxonomist on the stand that agrees with the fact that the plants are different, which would in all likelyhood bring about reasonable doubt as to the clarity of the language of that law?

one could further difierenciate the plants by their diferent chemical contents. i know both contain thc, but isnt there a giant variation in the content of cbd and cbn(i think those are the abreviatons) between sativa and indica?

you would get arrested and succesfully prosecuted if you were found growing Cannabis sativa of any variety.

as far as the THC argument... that would certainly not work in your favor.
