Serious questions have been raised about the Alberqueque Police Department after helmet footage from the fatal shooting of a homeless camper in the foothills surfaced.

The video, shows 38-year old James M. Boyd being shot and killed, in what appears to be the process of his complying with police officers.  New Albuquerque Police chief Gorden Eden says the video shows that officer involved shooting is justified.

Boyd argued with officers for three hours about his illegal camp in an open space. As the confrontation dragged on an APD Crisis Intervention Team officer and a State Police liaison were called to the scene. Both attempted to speak to Boyd, but the man threatened to kill officers if approached.

When Boyd attempted to grab bags and leave, officers threw a flash bang and released a K9 which appears to bite Boyd in the hand. Chief Eden said officers also used a taser gun and bean bag rounds. Boyd pulled 2, 2-inch knives when two officers, Dominque Perez and Keith Sandy then both fired three bullets each from their department issued rifles, causing Boyd to fall to the ground.

The APD is still waiting on an official from the Office of the Medical Investigator to determine how many shots hit the homeless man.

On the other hand, the video that Chief Eden released seems to be damning the officers rather than redeeming them, as Boyd appears to be turning away from the officers when bullets were fired. Eden stated that officers attempted to use all non-lethal forces first, and that there was a direct threat made to an unarmed K9 officer. Boyd was less than 8 feet away from the K9 when he pulled the weapons from his pockets.

After the incident it was discovered that Boyd, who had mental health issues had a history of violence stemming back 20 years, including incidents in which he attacked police officers. On top of this, one of the officers involved, Keith Sandy, has a notable history with New Mexico law enforcement. The officer was fired in 2007 after being accused of fraud for making money doing private security work while on the clock for State Police.

Sandy was hired by APD, as a civilian employee and normally wouldn’t have a gun or a badge. However, the officer quickly rose through the department, and ended up on the ROPE Team, which goes after repeat offenders or some of the city’s most dangerous criminals.

The two officers who fired shots remain on leave. Boyd’s family has yet to be located.
