It's clear their interest is in making obscene profits off cannabis users, not promoting their civil liberties.  They fired one of their faculty, a longstanding member of the medical cannabis and legalization movements, simply for expressing his belief that people should be allowed to grow their own cannabis without paying exorbitant taxes.

I don't have any problem with some taxation if that's what it takes to make it legal in the short-term.... but it's clear that Oaksterdam's priority is not legalization, but simply making fat stacks of cash.

Fuck them and the horse they rode in on :kingcrankey:

Maybe there's more to it then what's been presented to the public.  Perhaps there was some other motivation behind the scenes that led to this guy being outed.

How'd he express his opinion?  Maybe that had something to do with it.  Was he being a dick?  Sometimes people just don't work well together.  And then push comes to shove and whoever has more political clout is the last man standing.

Also, I thought Oaksterdam is a district of stores.  Or is there a single store with that name?

Sounds like the guy has some "stick-to", I'll wager that he'll probably find another place to work at and/or keep being active in the medical marijuana movement.

From what I can find, he mostly expressed his opposition through pubic speaking engagements, speaking primarily against taxation of medical cannabis (because medicine is not a taxed commodity in any US state). 

And Oaksterdam is a "cannabusiness" school, not a dispensary.

I don't have a link to any major news articles about it since they're not particularly concerned with the goings-on inside the legalization movement, but there's been some discussion of it on norml and other  legalization organization websites.

Here's an op-ed piece about the issue that isn't terribly well-written, but seems to have its facts straight.

Hmm.  That is fucked up.  Peron really does have quite the track record.

But really though, a big point of all the recent fuss regarding legalization is the possible economic implications (taxes) of regulation.

If anybody in the world could just grow it as much as they wanted without any problems, then who would make any money? 

Who the hell would want a guy working for them, when that guy is actively campaigning to take away your profit margin?

I totally agree with you though.  I want to see it legal and tax free.  And all I've ever wanted to do is to have a hobby in growing bud without the accompanying paranoia.  Bummer.

Freedom, I agree that editorial is taking things too far... but at the same time, I think a lot of these medical activists pushing for pseudolegalization are taking things even further afield in the wrong direction.

I have no problem with compromises to get cannabis legalized... but when those "compromises" aren't being insisted upon by the opposition, and in fact only serve to line the pockets of the ones proposing the "compromise"... that's where I get :crankey:

Once they admit that it is not going to destroy your life, they will have to lower the penalties for someone growing pot, because then the grower isn't thought of as a distributer of poison, just someone going around the system like the moonshiners, the moonshiners who are not nearly as heavily prosceuted as the pot growers are now today.

It's like a weed labor union. As a liberal, I'm not opposed, people need these jobs, who cares if pot's expensive. If he advocates growing at home the price of marijuana will plunge because it's too easy to grow. A low price isn't good for anybody, even potheads.

Please explain how having a larger portion of my income to spend on consumer goods is bad for the economy.  It seems to me that would stimulate the economy a lot more than having to spend $300 to $800 a month to stay high and having very little extra left over to support the economy as a whole.

All that'll do is force a lot of users to continue breaking the law, growing their own illegally. Taxing something to an extent that the people who consume the most can scarcely afford it is just bad economics.

I have no problem with the taxes going to the government, they need some incentive to get the ball rolling. Fighting to bring those taxes down to a reasonable level can be a battle for tomorrow.

What I have a problem with is a prohibition on growing your own.  Rather than being able to pay your tax to the gov't, you'd have to support the profits of the very same people who want the law to prohibit you from growing your own.  That's the part that I think is fucked up.

The only way that would be different from the current situation is that right now the law subsidizes black market profit margins.  If people like Rich Lee (the proprietor of Oaksterdam) get their way, then the law will subsidize profits for themselves instead.  Call me a lunatic, but I believe in a free market.  With a commodity like cannabis, profits do not need to be subsidized

Weed is an American product. Spending money on other consumer goods will help wherever those goods come from, probably China. That's fine, but more money here is more money here. It's too bad that guy got fired, but cheap weed isn't a necessity unless you're in excessive pain and really can't afford it. I'd like to see free weed for people too sick to work too, but I can't imagine California is at that stage with their current budget. Somebody will just have to be generous

When the taxes are so exorbitant that the only way to get weed for a fair price would be growing your own, but growing your own is illegal, I see a problem.

Exactly.  All it'd do is replace an illegal cannabis dealing trade with an illegal cannabis growing trade. Anyone smoking a reasonable amount would still be criminals because they'd have to grow to afford it. It's like a wolf-in-sheeps-clothing brand of prohibition.

so you're saying that giving money to the businesses would create a moneyed special interest that would lobby for prohibition of growing your own, which would ultimately make it harder to legalize growing your own in the long?

I extremely confident that if this bill passed everybody would grow their own. They already do grow their own with medical cards and the vast majority never have to talk to police or show their medical cards while having trees in their backyard. What Oaksterdam did was controversial and fucked up, but this bill is still a step in the right direction. There will inevitably be taxes on Marijuana, think of all the god damn tourism this would bring. That doesn't mean the the citizens of California have to pay them, they can just grow...

Well then, people who can grow and brew don't have to worry then. But from a business perspective, it's not good to teach people to grow unless you're selling seeds. If you're selling what comes from the seeds and telling them to go buy seeds, then you might want to go start investing in soil and fertilizer.

Have you read the initiative? They'd allow 25 square feet for cultivation. That's a total 5 foot by 5 foot space for your grow, your clones, and your mother.  What the fuck kinda yield can you get with that?

they say that.. but nobody will knock on your door. In humboldt county you can have a 10 x 10 area and people grow acres and acres with no trouble and the police know and couldn't give two shits.. Trust me on this one, this limit won't be enforced and is still a step in the right direction. If this passes the police are going to be thrilled not having to deal with people dealing 40 lbs at a time anymore.. guns, sketchy business, the whole medical marijuana situation which is a run around for police.

its a joke. their tax cannabis 2010 is all about greed. It doesn't protect the users, infact it does the opposite. All it does is add more regulation and limits to the user. It also allows counties to say if you're allowed to grow, so of course every county but oakland will outlaw it. most places will contiue to discriminate.

I guess since Cali already has prop 215 so anyone can get medical regardless of whether they have any legitimate claim to it, there's no real harm in passing this thing.  Just pay your $150 a year and you can actually grow, rather than just have a 5'x5' space.

exactly my sentiments. This does nothing but add more regulations. All I want is a bill to protect against discrimination. Its not right that some counties continue to create problems for medical marijuana users.

tax cannabis 2010 does not do this, it does the opposite.

This too has began to bother me.

Since Michigan finally became a Medical state, so many people seem to think they can make green $$$!

I was talking to this kid who thinks you can just grow and sell marijuana. Then he carried on about how he will charge different prices for different strains and shit, all I could think about is what a tool bag this kid was, and he didn't even know what his overhead would be, plus the retainer for an attorney when his shit hits the fan as it inevitably will. Oh well, not my problem.

I told him the laws were not meant to be that way.
Its just sickening to see that people only care about cash, and that stupid college kids that can't even read the fucking law, which directly prohibits making profit on the exchange of medical marijuana think this is the way to economic self prosperity.

I can't wait until I don't have to buy bud any more. Fuck the profits from it, I just wanna smoke, and smoke out those around.

These are both questions. It is not possible for questions to be hypocritical. They might be loaded, but the age requirement seems like a good idea to me since brain development occurs into the 20's. Remember that they are legalizing medicine, so a Doctor could get around these requirements if the situation required, which it usually doesn't. You shouldn't be so judgmental, I think the age is a little high too, but it's the government and they want to be careful not to cause massive amounts of schizophrenia at high schools. They've already got autism to deal with.

You need to define "harder on weed smokers" by pointing out a specific item in the bill that I can agree or disagree with. This is what leads you to say "Whose side are you on?" You are just getting angry and confusing yourself.

As for the bill that I read, it made no mention of specific tax increases that I saw, It issued the power of taxation to local authorities making it possible for them to tax. This isn't a tax or even a restriction, it's posturing to allow for tax increases down the road. You can't reap a harvest early, but you can prepare. These taxes can be heavy or light depending upon cooperation. Without this bill, what rights do you have?

Sometimes you have to give a little to receive a lot. I understand that you don't like government, but tough shit.

dude, did you miss my entire post or what? You don't have to give shit. Why would anyone want to pass a bill that did nothing for them but add stricter regulation? Why would I ever want to limit my intake to one ounce when I could as much as I want right now? Why would I ever want to limit how much I can grow, when I can grow unlimited right now. Why would I want to pass a bill that doesn't protect the user from discrimination? Why would I want to pass a bill that doesn't free existing non violent marijuana offenders.

The whole argument here is a little ridiculous, but remember that California can always take away what it doesn't fully give. Working against the state won't help push anything forward. People will just see it as a "drug" enterprise which pays no taxes and therefore has no necessity or possible legitimacy in the state as a business. And don't forget about the feds who are itching to pull the trigger on the whole situation. Go ahead and don't pay taxes, see what happens.

It's not replacing it, but (as I read the measure) the taxes will apply to medical cannabis as well as non-medical... making California the first state in the nation to tax consumers buying their prescription drugs :shake:

I agree, it's an unfortunate part of making a deal with the devil, we want legalization, some other groups don't care about it and another group is apposed to legalizing it ever, but all need and want money, so when you make it look as if there is a bunch of money to be made by legalizing with extreme taxation, it is a step in the right direction, a step towards legalization if at a cost.

maybe one day enough people will be actually into it and become a larger voting age majority and then the taxing or the amount can be tweaked, but for now lets just accept the positive step forward.

Morican, that's an excellent argument in favor of taxing it, and to that I have no objection.  What I object to is that the bill is structured so people cannot grow enough for personal use (I have no problem with people paying taxes on their grow-ops, but I very much object to preventing people from legally having a personal grow-op... 5x5 is just not enough).  That means that the profits (minus taxes) all go to the exact same people who are pushing so hard for this bill.

They put a happy "legalize it" front on the thing, but really all they want to do is to take the black market profits for themselves. That's what's fucked up.

I don't think you'll find many people opposed to taxation if that's what it takes to get it legal.  But this proposition isn't just about taxation, it's about structuring the law to disproportionately benefit the dispensaries, and keep legal sanctions on anyone who doesn't want to feed into their bullshit. 

The medical cannabusiness crowd knew that a tax-to-legalize bill would come up soon with or without them... so they decided to beat everyone to the punch so they could structure the law to essentially give them a monopoly.  Face it: There's NO good reason to restrict homegrows to 5'x5' except to line the pockets of the people who are pushing so hard for this proposition.

I've grown twice in my life before all this medical marijuana legal right to grow and I did it in a smaller area than 5x5 and yielded almost enough (my second time) to almost supply myself and my best friend in bud for a year, but I had to store in the fridge and freezer.

There are ways around the 5x5 restrictions, or rather ways to maximize the small space.

I am just happy to not have to go to my dealer and leave with the fear of getting pulled over down the street, I pay more now for my bud but have a bunch of different types available to me at any given time and can drive away with it in my trunk with no worries about the cops.

Some day we might have freedom but as long as we have a money grubbing, cash strapped government that can put us in jail whenever they want, freedom is for the rich, it's capitalism that we hate not the medical marijuana or legalization movement.

bro your not getting it. There is a one ounce personal limit on tax 2010. How can anybody possibly grow weed, and stay under one ounce. Should we throw away the rest? I can go through an ounce in one sitting.

tax 2010 is bad all around, not because im opposed to taxes. While I would rather not have to pay them, I feel you will never get around them if you want legitimacy. Its the other parts of the bill that are flawed. And i feel that the bill would go through without those assine limits and restrictions, so why have them in there? Ill tell you why, so oaksterdam can have their monoply that they have been fighting so hard for.

My bad, I didn't read the actual language of the bill, but yeah an ounce is not enough to justify growing, I guess how it can work is to sell your excess to the shops and then buy back at your leisure. We need to find and exploit the lop wholes, play the game to our advantage, if there is a way at all.
I'm thinking of starting a legal grow operation soon and will need to know my legal in's and out's before doing so. I will post my finding as soon as I find a way around the man that benefits us all.

A good analogy just occurred to me: Think back to the early days of the civil rights movement... imagine if Dr. King and a couple of his friends proposed some legislation that would do away with segregated schools, bathrooms, water fountains, etc... but required all minorities to pay an annual surcharge to Dr. King's ministry (or at least a ministry of the same denomination) in order to gain those rights.

Do you think the oppressed minorities would hail that as a victory, or even a step in the right direction?
