Creationist student cost California taxpayers $378, 000
    #11629036 -

Student sues teacher, school board and the teacher's union for violation of civil rights; records teacher's anti-religious comments.

20 statements were entered as evidence against the defendents. Judge rules 1 statement violated the paintiffs civil rights when Corbett, an Advanced Placement European history teacher at Capistrano Valley High School in Mission Viejo, was found to have violated the First Amendment's establishment clause when he referred to Creationism as "religious, superstitious nonsense" during a fall 2007 classroom lecture.

The school district was found not guilty, yet footed the bill.

1. I guess a teacher cannot make a true statement.

2. This frivolous lawsuit by a caring Christian is helping to further bankrupt the state.

Yay! Money for better computers and teacher's salaries? Sorry, we have to pay off fucking idiots.

The teacher Jim Corbett writes:

The reporting on this story has been driven by Chad's lawyers who used several out of context, but apparently outrageous, comments as a means to raise funds for their "legal ministry."

Chad taped many hours of lecture, all in violation of state law. He then filed a lawsuit without ever coming to me or the principal with his concerns. This, despite the fact that I send a letter home (which he admitted he received) inviting parents who have concerns to call me at my home or email me at my home email.

It would be boring to enumerate the ways in which my comments were misused but let me respond to the, now famous, "Jesus Glasses" quote and to the "superstitious religious nonsense" quote that Judge Selna (a Bush appointee) found in violation.

The "Jesus Glasses" quote came during a lecture on Joseph II the enlightened despot who tried to free the serfs from their servitude to the monasteries, seize Church lands, and distribute those lands to the landless peasants. In response, the Church, with access to the peasants during services, convinced those peasants that Joseph was working against God. In effect, I said, the Church put "Jesus Glasses" on the peasants and they couldn't see their own best interests.

The "superstitious religious nonsense" quote was a reference to another lawsuit filed against me my another "Christian" fundamentalist over 17 years ago. In that incident, John Peloza, an erstwhile biology teacher at my school was teaching "young earth creationism" in his public school biology class. I was adviser to the student newspaper at the time which published an editorial pointing out (correctly) that Peloza was teaching religion, not science in his class. The case was thrown out of court as a "frivolous case filed in bad faith." A student asked me about the case in Chad's class. I explained what Peloza was teaching and noted that when the District supplied attorney brought all those sued by Peloza together (he sued the Principal, science department chair, superintendent, Board, et. al.), the first thing he told us was to make no public comments until the case was resolved. I told the boy in Chad's class that at that point, I stood up and said, "I will sign a statement releasing the District from any obligation to defend me in this case, but I will not leave John Peloza alone to propagandize kids with his "superstitious religious nonsense." Judge Selna simply ignored the clear reference to Peloza's teaching and claimed that my comment was directed at "Creationism."

The irony to all this is that fundamentalist have long insisted that "Creation Science" is science, not religion, but now that they claim my comments violated their religious rights. BTW, if anyone wants to know what I think of "Creation Science" "intelligent design" or any other attempt to rename divine creation, they are all "SUPERSTITIOUS RELIGIOUS NONSENSE."

OC, Christians are always under attack.

A womans right to choose, teaching evolution in schools, gays getting married and now this!

Well it's just icing on the cake, someone had to stand up and say "no more, you wont attack my right to believe anymore".

What a brave man.

Creationists say Creationism is a science (which is not protected under the Constitution). In this case they call Creationism a relgious belief.

So which is it? Make up your minds! :waits:

it's both. When they want to teach it in schools it's a science however as soon as someone questions it, it's religious. which is stupid because then it can't be taught in skools

Shimmer

Wife.....Gilda Radner
Husband.....Dan Aykroyd
Spokesman.....Chevy Chase

[ open on suburban kitchen, Wife and Husband arguing ]

Wife: New Shimmer is a floor wax!

Husband: No, new Shimmer is a dessert topping!

Wife: It's a floor wax!

Husband: It's a dessert topping!

Wife: It's a floor wax, I'm telling you!

Husband: It's a dessert topping, you cow!

Spokesman: [ enters quickly ] Hey, hey, hey, calm down, you two. New Shimmer is both a floor wax and a dessert topping! Here, I'll spray some on your mop.. [ sprays Shimmer onto mop ] ..and some on your butterscotch pudding. [ sprays Shimmer onto pudding ]

[ Husband eats while Wife mops ]

Husband: Mmmmm, tastes terrific!

Wife: And just look at that shine! But will it last?

Spokesman: Hey, outlasts every other leading floor wax, 2 to 1. It's durable, and it's scuff-resistant.

Husband: And it's delicious!

Spokesman: Sure is! Perks up anything from an ice cream sundae to a pumpkin pie!

Wife: Made from an exclusive non-yellowing formula.

Husband: I haven't even touched my pudding and I'm ready for more!

Wife: But what about black heel marks?

Spokesman: Dirt, grime, even black heel marks, wipe clean with a damp mop.

[ Husband accidentally sprays Shimmer onto the floor ]

Husband: Oh, sorry, honey, I'll clean that up!

Wife: Oh, no problem, sweetheart, not with new Shimmer!

[ Spokesman laughs continuously as he approaches the camera ]

Spokesman: New Shimmer, for the greatest shine you ever tasted!

[ fade ]

it seems to be that the way to solve this whole thing would be to ask them once and for all:

Is creationism science or religious?

If they respond science: criticize the fuck out of it until their heads explode
if religious: get it the hell out of public schools

Hey, at least the student approached the teacher and the principle to resolve the issue before filing a lawsuit and lining up appearances on O'Reilly and Hannity - NOT!
