A baseball bat would of sufficed, and you could of hit him a couple times more and he wouldn't of died.  Although, you probably could of carried a flashlight with you and wave it around and the guy would of ran off.

and then in typical american fashion the burglar would have sued for
millions, the burglar would have pressed charges making the claim that
he was invited over and dude went apeshit on him because he wouldnt suck

I just think what the guy could do to my wife and kids if i were not at home to protect them. Someone breaks into my house and i assume he is there to rape, murder, steal, torcher, molest, destroy and ruin my life or possibly end it. The mother fucker is going to die. I wouldn't pause for a second. The safety of my wife and kids mean more to me than anything, and there is no way I'm going to try to either talk to the guy or simply beat him up and wait for the cops. Chances are if i don't kill him something bad will happen to me in the future. The guy could blame me for any number of things, and then take revenge in any number of ways. Better to just end the whole mess with my shotgun.

Also if you break into someones house you should know that if said person
is home they will likely defend themselfs. God knows I would. Maybe we would have less break ins.

absolutely it could be but the evidence obviously suggest the cops
bought the story, I mean it;s not like the kid went out, killed the guy
and dragged him back in the house so the plausibility of the story is sound
