are you legally obligated to speak with police officers?
    #5142452 -

lets say your walking along minding your own business, have not commited any crime, are not in possession of drugs or whatever, sober, law abiding, etc

a cop pulls up beside you and starts asking you bullshit questions about who you are, where your going, weather you do drugs, etc etc...

are you legally obligated to even stop and speak with a cop if they have no charge against you? is it legal to just keep walking and act like you dont hear them?

im particularly interested in canadian law but this is something everyone should know.

So yeah... if you have done nothign wrong, are in possession of no illegal substance and have no charge against you, are you obligated to answer a cops random bullshit questions about what youve been doing, if you smoke pot, etc?

and also, are you obligated to provide ID to a cop for no reason at all?

again canadian answers especially but everyone should know this.

thanks alot

peace

I think under Canadian law all your obligated to tell them is your name, age and address, nothing more no matter how much they hassle you.

If I wanted to keep on walking I would.

If you do get hassled or arrested then complain as much as possible. Try to sue the officer involved for harrasment and infringment of human rights.

Not that we have any human rights anymore...

There's a lot of information about these types of questions at NORML National Organization for the Reform of Marijuana Laws.

My understanding is that a cop can detain you, in which case all you're required to do is identify yourself or present your ID if demanded.

Beyond that, if you don't want to interact with the cop, it's important that you say so clearly as in, "I do not wish to speak with you. I do not consent to a search of my person, my property, or my vehicle. If I am not being detained or arrested I wish to leave now". Don't just walk away; establish that the cop is not detaining you, then announce your intention to leave, and if the cop doesn't stop you, only then leave.

Check out the NORML site for lots more, and send them a donation if you can. They have done a lot toward helping the medical marijuana cause and are constantly pushing for decriminalization.

The five most important words that you can use...

"I have nothing to say"

Don't lie, because thats a crime to lie to the pigs. "I have nothing to say"

Doesn't sounds like a good idea ether way. In my experience, the less often you piss of cops, the less often they kick your ass when no one's looking.

In the UK a police officer can ask your identity, if you don't give it or you give false information you can be arrested.

Yes, this happened to a friend of mine recently.

He's a good guy very sound very logical, wouldn't harm a fly.

He stated "I'm walking home theres no reason for my to give you my name and address, I just want to walk home."

With that, the British police seized him chipped his tooth by smashing his face on their car bonnet, cut his wrists and he has bruises on his shoulder and sides from how heavy handed they were.

We are considering protesting or starting a group which we may call C.A.P.B (Citizens Against Police Brutality).

Luckily he got the numbers of the officers involved, he's taken photographs of the injuries they inflicted and is in the process of attempting to sue the police force.

TAKE A STAND PEOPLE, ITS ARRESTABLE HEAR TO EVEN MAKE A POLICEMAN THINK YOU ARE GOING TO ASSAULT HIM SO WHY CAN THEY ACTUALLY ASSAULT US FOR NO REASON!

The people shouldn't allow this to happen, if it continues we can expect a similar situation to Nazi Germany.

In England and Wales you have to give basic details such as name and address, if you don't or they believe you may have given false details, you can be arrested. But you will find that the more compliant you are, the less likely they are to try to arrest you. Research has been carried out over here which found that if you were arrogant or off in anyway with them, they would find a reason to arrest you, how ever small it is.

Yeah, I'm pretty sure you are obligated to at least identify yourself, but you are not obligated to talk to an officer unless you are involved in a crime (witness, suspect, victim, etc.) and even then you always have the right to remain silent.

There are a lot of complicated laws regarding "obstruction of justice" and other such fooey, so I'd read into that if you are really curious..

Cops and judges work differently.

A cop can do what he/she wants while a judge MUST follow the law..

Thats not to say that a cop would break the law but lets say that one informed that they are investigating an incident. If you refuse to answer questions then they might arrest you for impeding an investigation.

If it holds or not would be up to the judge. Which is the case in all too many situations. Cops just love to bend the law and cuff people and let the judges and magistrates figure it out later after youve been harassed.

Really though, you only need to identify yourself to a cop in the US and you can be detained until your identity is proven.

i would give them the finger. if you get arrested, you have great grounds for a lawsuit. i think pretty much every american state has had cases such as that, and punative dammages have always been paid to the person who got arrested for giving the finger.

The best thing to do is to become totally ignorant. Utilizing "I don't know anything" and "I have no idea." And always look them straight in the eye: never break eye contact, let them do that. Ignorance + determined eye contact + emotionless facial expression. Become a zombie.

"Fuck da police" yeah you have to show i.d. if your being detained for some reason or another but questions can and should be left unanswered. The mpre info they get the stronger they become

"If I am not being detained or arrested I wish to leave now".
... establish that the cop is not detaining you, then announce your intention to leave, and if the cop doesn't stop you... then leave."

On a particular night, there was trouble in a neighborhood that I was in.  I was walking outside and suddenly completely surrounded by police. They asked for some information about myself... I gave nothing too in depth.

I said this very thing... practically exactly as it has been written here, by Diploid...  And then I walked away.

I was not stopped by the officers thereafter.

This is a CANADIAN reply to your query.

By the way, cops will sometimes word questions to confuse you into consenting to a search.

For example, if a cop asks "Mind if I search your car" and your answer is "No", you've given consent. This is why you have to be very clear and say "I do not consent to a search of my car".
