New Mexico Legalizes Shroom Growing

Although a technicality allows the GROWING of magic mushrooms, it is still QUITE illegal to posess them. I'm getting a migraine...

SANTA FE (AP) - The state Court of Appeals says growing hallucinogenic mushrooms is not banned under New Mexico?s law against manufacturing an illegal drug.

The appellate judges overturned the felony drug trafficking conviction of an Alamogordo man for growing psilocybin mushrooms in his home.

Under state law, drug trafficking includes the manufacturing of illegal drugs.

But the court says growing mushrooms was not covered by the drug trafficking law?s definition of ?manufacture.?

The hallucinogenic substance in the mushrooms, psilocybin, is an illegal controlled substance under state and federal law.

Technically, if manufacturing is not defined as growing by law then it should apply to pot as well, but that might not fly when tested in courts. I dont know detail of the case but it should apply if its done fairly.

It's like having a law within a law.  Nothing says you can't grow them, but to grow them you have to be in possession of them  :foreheadslap:

Thats similar to what happened in the UK before...fresh shrooms were said to be legal, because psilocybin is illegal, not mushrooms that contain them (unless prepared to injest them for their chemical). The courts there say your not growing psilocybin, which is the illegal drug, your just growing something that naturally produces it...thats actually pretty cool...good for that guy!
