Court Rules Against Pot For Sick People

WASHINGTON Jun 6, 2005 ? Federal authorities may prosecute sick people whose doctors prescribe marijuana to ease pain, the Supreme Court ruled Monday, concluding that state laws don't protect users from a federal ban on the drug.

The decision is a stinging defeat for marijuana advocates who had successfully pushed 10 states to allow the drug's use to treat various illnesses.

Justice John Paul Stevens, writing the 6-3 decision, said that Congress could change the law to allow medical use of marijuana.

The closely watched case was an appeal by the Bush administration in a case involving two seriously ill California women who use marijuana. The court said the prosecution of pot users under the federal Controlled Substances Act was constitutional.

"I'm going to have to be prepared to be arrested," said Diane Monson, one of the women involved in the case.

Stevens said the court was not passing judgment on the potential medical benefits of marijuana, and he noted "the troubling facts" in the case. Monson's backyard crop of six marijuana plants was seized by federal agents in 2002, although the California law was on Monson's side.

In a dissent, Justice Sandra Day O'Connor said that states should be allowed to set their own rules.

Justice Department spokesman John Nowacki said the department is pleased with the court's decision, but refused additional comment about whether federal prosecutors would pursue cases against people like Monson.

Under the Constitution, Congress may pass laws regulating a state's economic activity so long as it involves "interstate commerce" that crosses state borders. The California marijuana in question was homegrown, distributed to patients without charge and without crossing state lines.

"Our national medical system relies on proven scientific research, not popular opinion. To date, science and research have not determined that smoking marijuana is safe or effective," John Walters, director of National Drug Control Policy, said Monday.

Stevens said there are other legal options for patients, "but perhaps even more important than these legal avenues is the democratic process, in which the voices of voters allied with these (California women) may one day be heard in the halls of Congress."

I'm always amazed that this man can be the head of the National Drug Control Policy. He's lying through his teeth for a number of reasons, and I can't figure out whether it's a ignorant lie in which he really believes what he's saying, or whether he's simply putting on a "tough on drugs" front. Either way, it's astonishing that a man can make such claims and still hold a high position.

Ok, so if someone is in pain from some sort of illness and they smoke weed and state that it relieves said pain, and even prefer it over other pharmacueticals... isn't that effective? Do we need to prove that the patient cares more about relieving physical pain than getting high?

As far as being 'safe', I doubt someone with a chronic illness is very worried about "falling into the wrong crowd" or becoming "socially detached", which is about the worst side-effects of marijuana.

It's ridiculous. The men and women who are banking on other people's suffering that don't want to let them grow their own medicine should be ashamed of themselves.

We are simply following causality to the end of its long, destructive path.

The hatred of marijuana extends far back, and will continue on for at least our lifetimes. If we survive though, one day humans may grow more intelligent on individual freedoms.

There's a huge bureaucracy of people in power whose paycheck comes directly from the War on Drugs. This is why it will be a long, hard road to decriminalization, not because marijuana is dangerous or inefficacious.

I've said this before, but it bears repeating:

Donate the cost of a few joints to NORML. They're doing as much as any organization to push for decriminalization. Their minimum dues is $25, but they will gratefully accept $5 if that's all you can spare.
