Justice & Fairness

Justice is a structural objective standard. While life may not be fair (and it clearly isn't) when everyone plays by the rules, it is just. People come in all different sizes and shapes and abilities.

Fairness is an ongoing human subjective evaluation. Some prefer justice because they are content with the way things are and an unjust man is usually just someone complaining it's unfair.

Some prefer fairness because they are discontented with the way things are, judging a man as unfair, the man is criticized by someone who wishes to change the standard, and wishes to reevaluate the rules or change the game.

Justice is the every day rules, standards and routine. A breach of justice is usually caused by someone complaining, 'hey that's not fair! or that's not right!'

Justice is conservative, as it preserves the social order, whereas the critical attempt to make things more fair is liberal.

The liberal person who tries to appeal to fairness may have to interrupt or introduce himself by interrupting. The price we pay for appealing to fairness is that we may come across as 'unjust'.

The price we pay for appealing to justice or the justness of a situation is that we may come across as 'unfair'.

The Myth of the "Just" Meritocracy

Alain de Botton points out that modern society tries to make the world "just" by creating a meritocracy—a system where those with talent and effort rise to the top.

The "Just" Illusion: If a society is truly just in its distribution of wealth, then those at the top completely deserve their success.

The psychological consequence is devastating. If the winner deserves to win, then by that same logic, the loser completely deserves to lose. De Botton notes that we have shifted from calling a poor person "unfortunate" (implying bad luck) to calling them a "loser" (implying personal failure).

De Botton argues that true fairness requires acknowledging the massive role of "brute luck" and random chance in human outcomes. A strictly "just" system tries to grade everyone perfectly, but this is a statistical and human impossibility.

To find a kinder framework, de Botton often points to ancient Greek tragedy.  Tragedy acts as a counterweight to cold, bureaucratic justice. It shows that a person can be good, try their hardest, and still fail catastrophically because of forces outside their control.

Ultimately, de Botton’s philosophy suggests that a society obsessed with pure, mathematical justice ends up being remarkably cruel. True fairness requires a "kinder, gentler" approach that stops equating a person's social status with their actual human value.

I have three friends that are judges
they try to keep the ideas of fairness alive as much as they can.
the system is so bogged down that it is next to impossible.
precedent and minimum sentencing seems to hold sway mostly
