Arrested for trespassing and resisting arrest in the house i lived in.

So about a month ago I was told i couldnt live at my grandmas house and had to go to my sisters until i found i place to live. Legally i had to be served an eviction notice and that wpuld give me 30 days to leave.

Two weeks later i was at my grandmas and my cousin was there. I should add the only reason my grandma wanted me out was because my cousin and i so not get along because she stole from me. Anyways my grandma chose her side because she manipulates my grandma.

I went to my grandmas to go to work close to that house and instead my grandma starts an argument about how i can not be there if i dont get along with my cousin which i did not want to even acknowledge my cousin. She starts yelling and threatening me to get someone over there to beat me up. Then i only ever yell back about how she lets my cousin steal from me and walk all over me and my grandma which is my grandmas words. Then she tells me to leave and i didnt because i had nowhere to go so she calls my mom. My mom then calls me and i am on the phone with her calming down. This is when my aunt shows up and is outside with my grandma before she comes into the living room where i am sitting and sits across from me quietly. This made me uncomfortable so i went into the room i was staying on the phone with my mom.

My aunt pops her head in and asks to talk to me and i say im on the phone to which she replied with "you need to get your stuff and leave" i told her i wasnt leaving and to leave me alone before i say something she didnt want to hear. She didnt leave so i told her about her daughter and how she was walking all over my grandma and cussing her out and how she stole from me but all she did was call the cops saying i was high on drugs acting crazy and trespassing....


The cops got there and i told them i live there and im not trespassing and they told me i had to leave then the put hands on my arm and i obeyed what they lead me to do out of thr house. I was still on the phone with my mom and she heard everything even when i asked the cops why they would areest me i live there. When i put the phone up to my ear to hear my mom the cop said "fuck this" and put cuffs on me after taking me out of the house. He then took me to the car threw me into the car i hit my eye on the lights and i asked for a lawyer. I got to jail and i didnt stay but 8 hours and i didnt get a phone call or a chance to talk to a lawyer or anything.

I really feel violated and i dont really know how to approach this other than plea not guilty courts on tuesday and i could use and legal advice available. I want to add this is in michigan and they had no right to arrest me even if i was trespassing but legally that was my legal residence so i wasnt tresapassing. The cops didnt even ask for my id they were playing as my aunts personal thugs and my aunt is known for having an affair with a cop. Her neighbors have reported her having a cop at her house on duty just "visiting". She has told my mom that she has our county police wrapped around her finger and her daughter, my cousin went to my other cousins house the other day telling him that her and her mom are trying to ruin my life.  The cop my aunt had an affair with let my cousin go on prostituting herself. She follows in her mothers footsteps to say the least.

Any help or advice on dealing with court appointed lawyers?

Wait to see what your lawyer says before doing anything.

If you are in the United states and pay rent they technically have to give you a 30 day notice. It would be constructed eviction I think the word is I'm looking for.:shrug:
again I'm no lawyer so take what I say with a grain of salt.

Even if you are a guest living there you have to be evicted. The cops were wrong and I predict  prosecutors will drop the charge. You could then sue for false arrest if you want to go through the hassle. If they don't drop it simply show evidence you were living there and the judge will toss it out.

Even is something right or wrong or whatever, gotta know the law and know it well.  Just about no criminal feels they did the wrong thing.  Most of us where led by whatever feeling or whatever but gotta know the law.

That entire situation sounds like shit.


You had "nowhere to go" yet you're supposed to live with your sister in 2 weeks? I'm confused about why you were there. You said something about work but didn't go to work?

Avoid the place. No point sticking your fingers in a bee hive. If you can't live with your sister right now then ask her if she can at least store your shit and live in your car for 2 weeks. It's not that bad.

My sister and her bf were nearing the end of their relationship and she wasnt going to be at her house much longer so i was staying back at my grandmas for work until i found a place to stay. I woke up that morning at 6 am got there at 7 am went back to sleep and woke up to my cousin cussing my grandma out which she does often. My grandma and aunt tried to say i was on something and angry but i was in a room alone on the phone with my mom completely sober. None of what they say should hold up in court thank you to all who brought me some comfort in this situation. FUCK THE POLICE!!!

Ill update how court goes tomorrow

8 hours in jail? In the drunk tank I imagine? So you werent booked in or processed or taken to gen. pop. or have even seen a court date but you were released without bail? It sounds like they just detained you to fuck with you. Once youre legit arrested the only person with the power to OR you and let you go. Whole thing sounds weird honestly.

Edit - OR unless the prosecutor decides to drop the charges because he doesnt have probable cause or a strong enough case but that is not likely to happen in 8 hours. I spent a week in jail before they dropped my bullshit charges once. I was sitting there in my cell thinking they forgot to collect me for court then the next thing i know they are releasing me. Charges dropped. No explanation and I wasnt sticking around to ask questions.

I dont hold this against my grandma and youre right she is being manipulated. I love my grandma she was there for me through a lot and i lived with her for the past 2 years. I just want this to all go away.

I don't understand... did you bail out of jail? you never went before a judge... they could've just given you a ticket and told you to show up at the pre-trial or else a failure to appear warrant instead of making you sit in jail for 8 hours. Unless they wanted your finger-prints but they usually do that right before they send you up to general population after booking you in and sitting in the drunk tank forever. Where is Enlil when you need him?

I was taken to jail for 8 hours and I got a mug shot and my finger prints put in the system. They let me out at 5 am no phone call, no judge, just a ticket to appear in court October 3rd. It was for an arraignment. I was then told to come back for pre trial on Nov. 8th. And given a personal bond to pretty much stay away from my grandma and my aunt who seems to have made this all about her for some reason.

I now live in another county about an hour from my aunt or grandma so thats not an issue.

I have no record i should add.

This is really making me look at the corruption in the system in a different way...

Police will charge with what ever doesn't mean it'll stick, most ppl or to scared or ignorant of the law and go with whatever the public defender says.
Ive seen a dude charged with burglary first 5 times on his own house cause his baby's moma is a dumb bitch and they drop it to trespassing everytime so he cant sue.

Id take it trial if u got proof haha they hate taking small things to trial cause they lose money.
If they drop it sue, wait the 4 years to get the big money.

How many people are living at your grandmas place? It sounds like a madhouse. Get a job or two and get your own place. Stay with a friend until then.

You'll probably just get probation or community service if your lawyer can drop the resisting arrest. In the cops eyes it was rude of you to talk on the phone when they are trying to do their job. Even though they are mostly shitty people, you should be polite and mind your manners. Did they ask you to get off the phone? Are you telling us the whole story?
