My mother's ashes
    #24295989 -

So, my mother died a couple years ago. She divorced my father and married another man before she died.

The problem is that my step father has my mother's ashes on his mantel -- and I want them.

Is there any legal route I can take? Or does he own them because he married my mom. My mother wrote no will about her ashes. Further, he has my dead grandma's family pictures and refuses to give them up. Do I have any legal right to take him to court to obtain my mother's ashes and my family pictures?

I don't care about money or anything. I just want the ashes and pictures.

Maybe have a heart to heart with him and tell him how you feel? Is he the kind of person that would be receptive to that? Or do you not get along with him?

It's just a stuff. It's a shell.

The real treasure is the memories you hold and the times you had. The real treasure is the life she gave you. It's not worth struggling for an empty shell.

Meh, I would just wait till he goes to work and take them - IMO as her son and a blood relative they Should go to you and not him. That's probably really bad advice. I'd be prepared for hidden video cameras, and would wear a mask and not drive my car there. Would also replace the ash canister with a phony, and the picture book with random pics of department store photos.

Yes I would really do this if there was no alternative, but most normal people probably wouldn't. Fuck that dude though, this is family shit and a matter of principle. Do you have a key to that douchebags place? And why the fuck does he want pics of someone else's family? Did you have a good relationship with your mom and family?

Let me backtrack here, before you go breaking into someone's house. Why not make copies of the pics and just keep the copies, or give him the copies who cares?

Also, how long was your mom married to this guy? Does he have some kind of right by length of marriage, or because they had a real good relationship, or is he just a dick who wants to deprive you and your family of these items? I feel like there needs to be clarity before I can say 100% kick the guys door in

Spouses > children in these legal matters

Of course he has pretty much absolute rights over all her affairs. Unless specified in a will, everything she owned becomes his at her death and that included the right to decide what to do with her remains. Children have zero standing as long as he's alive.
