Man prosecuted for collecting rainwater * 1
    #21550938 -

You leftists will be thrilled with this but the rest of us are appalled. A man was actually prosecuted and ordered to serve 30 days in jail for collecting rainwater on his own property. He had some ponds and the state says it owns all water in the state and to use any of it even rain on your own property requires a permit. He got a permit then later they revoked it for no good reason.

If this isn't evidence of the creeping power and intrusion of the state I don't know what is. Things are worse now than in Stalinist Russia. At least then they let you keep your own rainwater.

SOURCE: COUNTER CURRENT NEWS

If Harrington is unsuccessful in his appeals, he will be reporting to the Jackson County Jail to serve his 30-day jail sentence.

His story quickly went viral after a rural Oregon man was slapped with fines for collecting rain water on his own property. But now, as of last Wednesday, Gary Harrington of Eagle Point, has been sentenced to 30 days in jail and more than $1,500 in fines, all because he had three reservoirs on his own property, that he used to collect and use rainwater.

Harrington says he plans to appeal the conviction in the Jackson County Circuit Court. That conviction revolved around nine misdemeanor charges that come from a 1925 law. That archaic ordinance bans what state water managers called “illegal reservoirs.”

“The government is bullying,” Harrington said in an CNS News, last Thursday.

“They’ve just gotten to be big bullies and if you just lay over and die and give up, that just makes them bigger bullies. So, we as Americans, we need to stand on our constitutional rights, on our rights as citizens and hang tough. This is a good country, we’ll prevail,” he added.

It all started back in 2002, when Harrington was attacked for having three “reservoirs” – ponds – on his large 170 acres of land.

But the state claims that collecting water requires a permit from the state.

One of these “reservoirs” – ponds – had been on his land for 37 years. He applied for the permit, which he saw as ridiculous. But the state firstapproved him in 2003, then denied him – reversing the previous decision.

“They issued me my permits. I had my permits in hand and they retracted them just as arbitrarily, basically. They took them back and said ‘No, you can’t have them,’ so I’ve been fighting it ever since,” Harrington said.

“Way back in 1925 the city of Medford got a unique withdrawal that withdrew all — supposedly all — the water out of a single basin and supposedly for the benefit of the city of Medford,” Harrington added, giving some history on the bizarre law.

But he claims that there is no mention or prohibition of collecting rainwater.

“The withdrawal said the stream and its tributaries. It didn’t mention anything about rainwater and it didn’t mention anything about snow melt and it didn’t mention anything about diffused water, but yet now, they’re trying to expand that to include that rain water and they’re using me as the goat to do it.”

Tom Paul, the administrator of the Oregon Water Resources Department, says that the law doesn’t need to ban collecting rain water, because all of the water in the state is “public water,” which doesn’t actually mean the water belongs to the public, it means the government has claimed ownership of it.

“The law that he is actually violating is not the 1925 provision, but it’s Oregon law that says all of the water in the state of Oregon is public water and if you want to use that water, either to divert it or to store it, you have to acquire a water right from the state of Oregon before doing that activity.”

In 2007, things got even worse for Harrington. A Jackson County Circuit Court judge denied his permits. They ruled that he had “illegally withdrawn the water at issue from appropriation other than for the City of Medford.”

If you think leftists would support such a stupid law then you are really just showing that you are too unintelligent to tell a sensible regulatory policy from an insensible one.

What is wrong with you?  Can you not make an honest point about anything?

Next sentence after your edit.

Yet Paul admitted the 1925 law does apply because, he said, Harrington constructed dams to block a tributary to the Big Butte, which Medford uses for its water supply.

“There are dams across channels, water channels where the water would normally flow if it were not for the dam and so those dams are stopping the water from flowing in the channel and storing it- holding it so it cannot flow downstream,” Paul told CNSNews.com.

Harrington, however, argued in court that that he is not diverting water from Big Butte Creek, but the dams capturing the rainwater and snow runoff – or “diffused water” – are on his own property and that therefore the runoff does not fall under the jurisdiction of the state water managers, nor does it not violate the 1925 act.

The man is a fucking asshole and I'll leave it my readers to figure out who else is an asshole.

You call that an intelligent regulatory policy? It sounds like you are one of the leftists who support it.

Zap, as usual you are in favor of big govt and oppressive regulations. Have you received your registered left winger card yet? He was prosecuted for the ponds, the so called dams were on his own property and did not obstruct the flow of any river. Buy a clue since you obviously don't have one.

We merely need to look under your name to see who it is.

Ah, a sensible person at last. I knew there were a few. Yes, it affects everyone because they start with one person then when they win in court they turn around and apply it to everyone. If you have a rain barrel and water your plants, that's "stealing" the state's water. If you have a little barrier so that runoff doesn't flood your garage or driveway, that becomes a "dam" and another charge will be filed.

if everyone did what that guy does, there would be a shortage.  There already is a water shortage, u just don't see it because its underground.  The water tables are being depleted, mainly because of the asshole water bottlers, the take our water we have, and ship it over to china, they stealin all our water, and im 90% sure thats what those underground buildings china built are, they are trying to buy up the worlds water.  And i bet anything its a water bottler that caused whats happening in cali

You think anybody should be allowed to build a dam across a stream on his property?  How about if I own the property upstream from you and put a dam across it there?  You would cry like a little girl.  You selectively edited the article to leave that part out and failed to provide a link.  You are dishonest.

It effects everybody downstream from this asshole.  This isn't liberal nonsense.  He dammed a stream.  You want to collect rainwater build a cistern.  But you cannot dam a stream and fuck everybody below it.

I remember someone telling me collecting rainwater was illegal and I looked it up and some states do have laws about it but for health reasons and shit. Also if you were to collect rain water in your own property you aren't depleting anything from the ground water source. That amount is so minimal and mostly evaporates back into the air once it lands, unless it's a torrential down pour. Capturing rain water is a very sustainable process and has nothing to do with depleting resources of the state. It has to do with the state wanting you to pay them so way. Permits and shit to ensure your setup will retain clean water etc.. sorta like fishing license for invasive species. They want that shit gone but of course you still need a permit. ass backwards.

That was my point about the cistern.  But it wasn't water that fell on this guy's property.

This is just part and parcel of Stonehenge's dishonesty.  No link and only part of the article up to the relevant issue, which was that this dick dammed a stream.  The water in that stream did not fall on his property.  All freshwater is rainwater.

They should be regulated, not someone trying to use what falls naturally on his own property. This guy was not selling anything, he wanted to water his own plants and whatever other use people put rain water to. He also was not taking it from a well.

Its the camel's nose under the tent. If we let the bastards and their troll supporters get away with this crap, they will say you can't breath the air blowing across. They will say the state owns the air, the water, everything. Hiel big govt!

Stop lying, zappa

I didn't make anything up and posted a link (which link you did not supply because you are dishonest) to the article you copy pasted but edited.  Here, I'll quote it again

"paul" is not the defendant, you are quoting some asshat on the other side like it was a fact. A fellow asshat I guess. Harrington clearly says he was not blocking any river or stream. Stop lying already! When you get caught in a lie you just tell it over and over again. The left wing tactic of the big lie. Maybe obumble needs a new spokesman, better apply.

The man is an asshole and a selfish idiot stealing water from downstream people.

http://www.britannica.com/EBchecked/topic/504336/riparian-right

Quote:
Riparian right, in property law, doctrine pertaining to properties adjacent to a waterway that (a) governs the use of surface water and (b) gives all owners of land contiguous to streams, lakes, and ponds equal rights to the water, whether the right is exercised or not. The riparian right is usufructuary, meaning that the landowner does not own the water itself but instead enjoys a right to use the water and its surface

Your ignorance of common sense law knows no bounds.

Actually, you're the guy who left out the biggest detail of the article. You're the fucking liar here. Zappa is right. You didn't even post a link, either so we could check it out.

Whatever. This has nothing to do with the fact he was "collecting a bit of rain water"
