Pulled over with bud

A person I know was pulled over with a quarter pound of weed and a scale.  He went to jail that night but was told by the arresting officer that a medical card could get the charges dropped.  yesterday, he got his medical card and his court date will be coming up.

Problem is, a quarter pound is 2 ounces over the legal limit.  Is this person pretty fucked with a QP and a scale? Jail time possibly?

Anyone know?  I dont know if they charged him with intent to sell. But either way, anyone have an idea of the possible outcome? Enlil?

It could go either way.  It is good that he got the card, but since he had more than the limit they don't have to honor it.  Depends on what kind of mood they are in that day.

Obviously he should bring the documents to court. 

Why did he get pulled over, why did they search him, and did he consent to the search?  What exactly did he say to the officer?

I dont know the exact details, he got pulled over because he was driving while completely benzo'd or something idk the exact chemical he took but its just like a xanny. He says he hit a wall and kept driving and Im assuming thats when someone either reported what happened or a cop saw it happen.

I doubt he consented to a search but im not sure if he would have a choice cause I know for a fact his car wreaked of weed and it had been hot boxed hours earlier.  Since he was pretty much blacked he cant remember everything that happened.

yeah i have no doubt that it was a legal search, he was the dumby who drove away fucked up with a QP and a scale.

Im just curious if he will face jail time or probation.  Whats really weird, when he got out of jail the next morning, he never got any slip listing charges or court dates and still hasn't.

Only if the Judge is dumb as fuck.

First, no dispensary would mix two patients meds together.

Second, you don't get to mix your meds with someone elses.

Third, even if you could find some other idiot to go along with your scheme, there isn't a Judge on the planet that would simply take your word for it.

I can't believe you even suggested it.

Dude you never have any constructive critcism, you just call everyone stupid or an idiot.

First, any two patients can get their meds at the same exact time and even put in one pack if they are together.

Second, yeah you can mix your meds there is literally no difference as long as there is more then 1 person so the legal amount isnt exceeded.

Third, it wasn't that bad of a suggestion.  At least it was a real one unlike ANYTHING you have ever contributed to the board.

No such luck. You clearly haven't done much reading if those claims are the best you got.

Pharmacists are not allowed to stick your meds in with someone elses. This is a federal law. While you personally may stick your meds with someone elses, this is also a violation of the law. Note I didn't call anyone stupid or an idiot, though some certainly qualify.

Lastly, the suggestion sucked.

Now, got anything to dispute that other than that last refuge of the feeble... "luv was mean to me once so I think he's a poopy-head"?

nah dude. ive had plenty. i just live in a very large city where there is so much crime the judges truly do look for any reason to let you slide on harmless crimes.

some judges arent looking to give people a hard time over mj. thats why i said, worth a shot.

I'm going to give you a protip, literally.  Judges aren't stupid.  They are going to ask questions of this witness.  This witness who was stupid enough to commit a felony to cover for his friend is not going to be smart enough to answer the judge in a way that will satisfy the judge.  Most likely, the witness will simply be scolded and sent home, but the OP will be fucked for trying to commit a fraud on the court. 

Here's a condensed version of the protip:  Committing a more serious crime to cover a less serious crime is almost always a bad idea.

youre probably right but this is highly dependent on where this crime took place and the judge AND prosecutor on the case.

most of the time ive had the prosecutor go along with whatever ive been feeding them.

i guess ive just had extremely good luck and counsel.

if it were me id just go in and admit what ive done and apologize for wasting the courts time. prior to the hearing id have completed some community service with a church group and have a pastor or priest write a letter on my behalf. stuff like that goes a long way. sometimes they like hearing you say "theres no excuse for what ive done etc etc". it shows you actually care about your life and future.

Hey Enlil thanks for replying. What is your take on the actual situation at hand though?  Do you think my friend could be looking at jail time? Probation?  He still hasnt received ANY papers about his charges.  I keep telling him to call the courts because if he misses it hes gonna be even more fucked.

I can't even begin to tell you the possible outcome.  Every state, county, and even judge is different on these things.  1/4 lb isn't a small amount, though.  Where I am, that'd be a felony, but probably probation if it's a first offense.  In some places, though, you'd be looking at doing time.

I dont wanna announce the state and county, maybe through a PM but thats okay.  I appreciate the reply. He got raided once but they went into the house without a warrant so charges were dropped, idk if a judge will take that into consideration. Im hoping he doesnt have to do any time, he is still blazing every day since he picked up his medical card which IMO isnt a good idea.
