This is true...but historically, the record companies have had all the cards....there are unlimited numbers of musicians to choose from...most of whom will take any shitty deal just for a shot at hitting it big...

i didn't read the thread but it doesn't worry me. first of all, these are all american authorities. i'm not american. :cookiemonster:

also, they can never stop internet piracy. its not possible. there will always be a new method, a new program, a new way of downloading. worst case scenario it just goes offline and into swapping hdd's. they are fighting an unwinnable war

just dont download big programs and new release content and majority of the time you'll be fine. only download things that have been released for a few months/a year and have had time to generate most of the revenue they are going to generate for the copyright holder.

It's just going to be a mess either way.

Honestly, I'm not too worried since I don't really torrent anymore. I just think the big record companies really need to find a new system rather than clinging to the old one. Most of the music I listen to is honestly by people who make their music available on the internet for free anyway. Record companies are just going to have to get over the fact that the internet has changed media.

They can spend as much money as they want prosecuting people for petty bullshit, but they hardly make much of a statement by doing so. Just because someone gets sued for sharing music doesn't mean the company sells a billion more shitty Pop CD's in the process. All the money they spend trying to get laws changed and prosecuting people can be better spent finding new means of making money off their product and accepting the fact that music has changed.

It's literally to the point where they can't even claim a monopoly anymore. Anyone and everyone has cheaper access to music making, and therefore there is more free music to go around. At this moment, you can download so much music that is actually put out for free, that is really good music, better than most of the crap the major companies spend millions putting out, and it will last you your entire lifetime if you wanted to listen to it all.

In the same way I don't pay a fee every time I look at the Mona Lisa online, I'm not exactly big on paying for music either.

I'm not arguing that the internet doesn't prevent music sales either. It most certainly does reduce hard copy sales. However it also promotes artists as well. The musicians and artists simply need to find a better way to promote their stuff in a way that pulls money in. There are plenty of business models that can get money through ad space, micro purchases and shows. And I'm not saying that music doesn't get expensive either, it can certainly leave people in debt if they place all their chips in the wrong places. However if these people get sue happy, 20 more artists will gladly take their place while they are busy being dickheads about it.

Artists are both making MORE money today, and more people are making music as well. The only people really losing out are the Major Record Labels, and to be honest, for every good product they put out, they spend another million dollars promoting a shitty one. No sympathy for them anyway. Let them stick to the radio and the TV while the rest of the world lives in the 21st century and uses the internet.

i agree that its only the way of the future for artists to be utilizing the internet. but this has two sides to a coin.

postive: generally companies tend to litigate and prevent people from making their music available online, however they don't seem to realise that this is just a form of free advertising for the artists. marketing students have it drummed into them from the beginning that the best kind of advertising is "word of mouth": hey man, check this shit out...it's awesome. it's free promotion for the artists.

as you mentioned before with ad revenue -- they could possibly start charging the big internet companies like youtube a higher fee for the right to play their music. more so then just the generic ad revenue that their accounts accrue from being a member of the website. theres lots of things that can be done.

negative: alot of online DJ's who now shifting away from the typical 'record label' based model (which is generally very restrictive, beauraecratic and slow paced), are now moving towards going into business on a stand-alone basis. i.e. releasing all of their content themselves through places such as Beatport, etc etc and all those online music purchase websites. the problem with this is that the artist basically gets screwed over and gets alot less money for their art (oversimpilified). so its a damned if they do, damned if they don't sort of thing. they forego all the restrictions and control of the big companies with the big financial backings to push their music and make it popular, but then lose out on their individual sales with music that doesn't get as much exposure and a far lower return in sales.

conclusion: artists these days need to realise that the money to be made from their songs is not to really going to be generated from releasing their music under the old model of albums and vinyls and whatnot. Look at Radiohead for instance, one of the biggest bands int he world at the moment -- they released their latest album online essentially for free. it was released on a basis where by the people could chose how much they would like to pay for the digital download, all the way down to $0.00. the money these days is to be made from tours, shows and merchandise. artists need to get out there and start building their customer bases. they need to start touring and earning their money.

but also in relation to the copyright prosecution thing -- the big companies aren't really prosecuting 'innocent' torrenters to catch a big fish or anything. they aren't really expecting that jimmy who downloads justin bieber on his universities network illegally is actually going to be able to pay the company the $200,000 account of profits they claim, it's more about deterrence for the general public and setting precedents, rather then a return on investment.

i'm sure they are well aware that they are losing money in pursuiing frivolous piracy based litigation, but they may be viewing it from the perspective that they may be loosing less by deterring other downloaders from doing the same, and thus encouraging them to purchase the next CD instead of downloading it. you can see it from their point of view as well, in that everytime someone downloads their music , its an effective loss of revenue.

but your right, they are fighting a losing battle, and need to put their efforts into innovating their products and practices , rather then just trying to curb what is already happening and what is going to continue on well into the future.

My internet speed goes from 5mb to 50mb next month............... my hard drive will fill up so fast
The majority of it will be deleted because it will be shitty, shitty music.
99% of people download for personal enjoyment, they aren't burning CD's and trying to profit in any way.
It's something to listen to while you drive around or sit on the computer.
I have torrented music in some form or another since dial up was around, I feel absolutely no guilt.

Music should be shared and enjoyed by all, I can listen to the radio for free.
I think downloading helps spread the word and if an artist is good enough then people will go to their show and see a live performance.
Buy merchandise, whatever.
If not, then whatever.

I dunno it's late as fuck.......... encryption ftw.
All this reminds me of that FBI logo when you start playing a VHS tape, or that tag on a mattress you aren't supposed to rip off.
Who gives a fuck.

Also he got a race car.

Hehe.. frivolous because they're not going to get any actual money out of 'jimmy the illegal napster downloader'. if they were after money they would take on big companies, or atleast they would do their research to take on infringers with deep pockets atleast. you gotta keep in mind also that in the legal system, you incur a hell of a lot of costs in pushing through to a judgement. so even if you win a judgement, the judge doesn't always award full costs to the winning party (meaning the losing party pays all costs, i.e. his costs, your costs, and the settlement).

its frivolous in the sense that it's not really going to achieve anything for them to pursue the protection of their IP rights in this fashion. they have not really been lead into loss by Jimmy downloading 3-4 albums ~total retail price ~$60, which they don't even get %100 of. and damage suffered is the basis of any civil claim. they are more just riding off the coat tails of the copyright legislation that has punitive penalties of "x" ammount of dollars for each instance of breach.

They don't get paid...but people get hurt by them...that's the whole point...If you have a garnishment on your wages for 10 years to pay off a $200k judgment...you learn something.

well ok, it is slightly frivolous in my opinion, in that it doesn't really advance their interests significantly and is not really necessary to bring the action. especially given that there are probably a few hundred thousand other infringers doing the same thing. i guess the better choice of wording would have been vexatious. it's like they play spin the bottle with whos economic future to ruin, for no real reason other then to make a statement. but your right, they are well within their rights to do so in defending their IP.

i just don't see the use of it . i think they should be going after the larger scale infringers and facilitators like megaupload/thepiratebay/0day/youtube etc etc etc.

I'd just like to point out that downloading illegal content on school internet is asking for trouble. Most schools make you login with your personal school username/password and can monitor everything you do.

I remember a couple years ago the MPAA and RIAA targeted a local university. They sued all the kids who were downloading with school internet. The schools threatened to suspend the kids. The schools internet was basically a honeypot for them to catch people. I believe all the kids caught ended up having to settle for around 4 grand.

Im sure their parents weren't to happy

There are many who agree with you...It's a legal construct, for sure...

Without that construct, however, there would be little incentive for much of the research and development that goes on in this country.

I don't necessarily disagree with the idea of IP. Inventors should be given a period of time in which only they can sell their product, for example. I should not be alowed to sell any of the CD's I may have downloaded, either. That would be taking money from the producer of the CD, since the person I sell to very obviously would have bought the CD legitimately.

However, I do disagree with the idea that personal use of a digital product (something which can be easily and exactly duplicated) equates to "theft".

If I wanted to create my own "copy" of a Lamborghini, for example, and I did so using 100% parts that I made myself, then I would be totally in the clear legally. As long as I don't try to sell my "copy" of the car as a Lamborghini, I would be fine.

So then why should we believe it's "theft" to copy a digital product?

Because copying the digital version of the product isn't making all of the parts...it's copying the end result...your analogy is okay if you copying a song is accomplished by recording the instruments and vocals...mixing them...and mastering them...

That is the work that the artists do..they don't enter numbers into computers...they play instruments...Lamborghini forges parts...

If you want to forge your own parts...you can...If you want to play your own instruments you can...

This is just another level of rationalization...

I don't think this is just a rationalization.  It would be if all record companies did was record, mix, and master music.  But for most record companies (and especially for big acts), most of their expenses come from discovering artists, advertising them, and distributing the music - things which you are doing yourself when you pirate music.

The fact that the music companies have the "right" to be the only ones doing that and profiting from it is a legal construct, not a moral one.  Morally I don't see why I have to respect their monopoly - I shouldn't be forced pay the record companies when DIY is a valid option.  Especially since the record companies know that these days that people are doing this - they're not some poor schmuck who got bamboozled into paying for property that's less profitable than he thought.  Suing pirates is like Big Agro suing small-time farmers for creating market pressure that lowers the price of BA's potatoes.

Quote:
Important distinctions have been made about the legality of downloading versus uploading copyrighted material as well as "musical works" versus other copyrighted material. In general, the unauthorized copying or distribution of copyrighted material for profit is illegal under Canada's Copyright Act., however the act also states under the section "Copying for Private Use ... onto an audio recording medium for the private use of the person who makes the copy does not constitute an infringement of the copyright in the musical work, the performer’s performance or the sound recording.".[3] Furthermore, the Act contains a Private Copying exception that makes it legal to copy a sound recording onto an "audio recording medium" for the personal use of the person making the copy. This is supported by a levy on blank audio recording media, which is distributed to record labels and musicians
