Interesting paper from two law professors

"The advent of file sharing has considerably weakened effective copyright protection.
Today, more than 60% of internet traffic consists of consumers sharing music, movies,books and games. Yet, despite the popularity of the new technology, file sharing has not undermined the incentives of authors to produce new works. We argue that the effect of file sharing has been muted for three reasons. (1) The cannibalization of sales that is due to file sharing is more modest than many observers assume. Empirical work suggests that in music, no more than 20% of the recent decline in sales is due to sharing. (2) File sharing increases the demand for complements to protected works, raising, for instance, the demand for concerts and concert prices. The sale of more expensive complements has added to artists' incomes. (3) In many creative industries, monetary incentives play a reduced role in motivating authors to remain creative. Data on the supply of new works are consistent with the argument that file sharing did not discourage authors and publishers. Since the advent of file sharing, the production of music, books, and movies has increased sharply."

Lets keep in mind the goal of Intellectual Property in the United States.  From the constitution:

"To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries."

I would point out that IP laws are designed merely to promote the progress of the sciences and arts for a limited time.  The framers never wanted Disney to own rights to Mickey Mouse for a century.  One thing that is very clear historically is that with less IP control comes more creative and interesting things that overall benefit society.  That Harvard paper comes to the same conclusion.  The constitution did not intend for IP laws to be useful only for the content creators, they specifically wanted the goal to be to Promote the Progress of creative content.

Would you also say that rap in the 80's was a scourge of music because it used remixed works by previous artists?  How about mixtapes?  When suddenly people could remix past works in the 80's a huge flurry of creativity poured out musicians.  How about the album Entroducing..... ?  Really just a mishmash of copyrighted works right....

Do you know why we have mp3 players?  It's not because the RIAA thought it'd be great to have people download mp3 files I can assure you of that.  File sharing has led to innovations in the marketplace.  People are going to have to drag these big creativity conglomerates into the 21st century.  The RIAA got dragged in after kicking and screaming, hell remember their slogan in the 80's that home recording would kill the music industry?  So file sharing is going to kill the TV industry now?

A simple check of the internet where copyright is virtually unenforceable shows how much creative content has been made from these copyrighted works.  There are entire sub cultures devoted to remixing parts of video clips or using video games to create a detailed movie story.  Not to mention all the photoshop, music remixing and any other kind of fan work you can think of.  If you the hammer came down hard on all of these activities you would negatively affect the global culture.  You might positively effect groups like the MPAA and RIAA but as I quoted earlier the goal of IP in this country is to 'promote the progress' of creative works.E
