Uh... what? DOI?                                                Florida:nonono:

I remember a thread about you getting in trouble for a DUI (driving under the influence) in Florida. But I don't remember anything about the drug DOI.

 The wild memories are rampant! I have never had a dui. Or a doi for that matter. *\Knocks on wood/*

Looks like I have a shitty memory too.

This is the thread I was thinking about
http://www.shroomery.org/forums/showflat.php/Number/11441584/fpart/1/vc/1

But it says something about a suspended licence, not DUI.

The other guy was a guy they got for selling hash, an obvious case of entrapment by the way.

The hash guy, the officer asked if he'd sell him any of his bud. The guy said no, but he'd smoke some with the officer. They went over and sat down to smoke, and he loaded a bowl. The officer could have arrested him right there, but instead the officer, after smoking a bowl with him, begged him to sell him "just one little bowl for 10 dollars." The dude relented and did, and instead of just nailing him with possession, they illicited him to commit a crime and got him with felony distribution. He told me he saw them pocketing his weed and all, laughing about how good it smelled.

That is not entrapment.

If the guy had never smoked weed before and the cop talked him into it and then got him to sell him some, that would be entrapment.

Since the guy had weed and it was possible to talk him into selling it, it was a legit bust.

From your link:
"In criminal law, entrapment is when a law enforcement agent induces a person to commit an offense which the person would otherwise have been unlikely to commit.[1]  In many jurisdictions, entrapment is a possible defense against criminal liability."

The hash guy initially refused to sell to the officer.  The officer had to induce the hash guy into selling by repeatedly begging him for a bag.  His initial refusals indicate that he would otherwise have been unlikely to sell it.  Sounds like entrapment to me.

"in Sorrells v. United States (287 U.S. 435 (1932)) unanimously reversed the conviction of a North Carolina factory worker who gave in to an undercover Prohibition officer's repeated entreaties to get him some liquor. It identified the controlling question as "whether the defendant is a person otherwise innocent whom the government is seeking to punish for an alleged offense which is the product of the creative activity of its own officials".[7]"

The problem is not the legal veracity of entrapment in this set of circurmstances but rather the simple fact that the charges originate in rural back-woods Florida.  The local DA and judge are not going to care one way or the other, they will be results orientated, i.e. their job performances will be judged on conviction rates for the DA and as far as the judge goes assuming he's an elected official (most seem to be in the South) he's not going to "go soft on crime."

Could an entrapment argument be made in higher courts and conceivably result in acquital, yes I believe so.  The question is does the accused have the financial resources to fight their case to that end.

The illusion of equal and fair justice is simply that, an illusion.

Definately not a legal bust. How is it legal for an officer of the law to break the law in the process of an investigation or a sting? I don't know what the county limits are out there but i know in my county that if an officer commits any illegal act in the course of an investigation it thereby negates all evidence found afterwards and your lawyer can EASILY submit a motion to suppress evidence on those grounds, and it'll more than likely be passed.

LEO are not subject to the same laws as civilians while conducting investigations. In the same way that a peace officer is statutorily exempt from laws regarding firearm concealment in almost every possible way, exempt from most traffic laws if responding to an emergency or pursuing a suspect, while conducting a drug investigation, they are statutorily exempt from the laws regarding possession/use of drugs. The Supreme Court has said it’s legal to utilize deception during an investigation as well.

So you're saying its legal for police to use drugs in order to bust dealers?

I really doubt that...  Maybe if the cop's life is in danger- if there's a big black guy saying "hit the crack pipe, or I'm gonna put one in your dome", then sure, I bet it would slide.  But smoking a bowl to try to get a guy to sell you weed?  I dunno.
In all the cop movies I've seen (not that movies are a legitimate source) the narc cops always have to hide the fact that they're dirty, the higher ups fix the piss tests for them (a good example is in Training Day).

Yes, they do it all the time.

Police are allowed to commit a less serious crime in order to bust someone for a more serious crime.

You can not suppress the evidence on the grounds that the cops broke drug laws.

Quote:
Exactly, it is a clear case of entrapment. The guy was incited to commit a felony when he was just guilty of a misdemeanor. His initial refusal to sell marijuana and instead smoke it shows he was not going around selling drugs. The officer then repeatedly begged him to sell him even just a bowl. Any appeals judge would see that the only reason this was done was to try to obtain a bigger charge from the guy, and he was incited to commit a crime by the police officer that he otherwise would not have committed.

That defense has been tried in court and didn't fly.  The reasoning was that all pot smokers have committed the offense of distribution at one time - even if it was just passing a joint.  Therefore they are predisposed to commit the crime and they can't get off on an entrapment defense just because the cop had to beg for the weed.

If it was someone who had never tried drugs and the cop got them to buy some weed and resell it, that would be entrapment.

That sounds like complete bullshit that wouldn't hold up in any serious court.

The wonderful thing about this story and every story like it is that if we all had more money, we would have more justice.

If we were all young republicans with nice hair cut's and daddy was a corporate executive that worked for wall street, bilking the nation out of it's future and sharing it with our illustrious officials; then things like this would be different.

I can only hope that someday all these backward ass, redneck, right wing cunts will have died of old age and been and replaced by generations of people that understand the idiocy of the prohibition of soft drugs.

But as long as there is money and careers to be made by making and enforcing laws that make criminals out of non violent drug offenders then welcome to the wonderful planet we call earth.

The motto of the Republican south:
"My daddy hated niggers and hippies and my daddy's daddy hated niggers and hippies; and I hate niggers and hippies too goddamnit."
