can you go to jail for threatening someone?
    #12284789 -

Just curious..
If someone sent you texts saying I'll see you very soon cunt, or I promise I will see you, or I'm sending some of my friends over, or I would stay out of such and such place, or just expect what's coming...

Is that enough evidence to give to the cops to put that person in jail?

Also theres a voicemail saying I will punch you in the face when I see you, among other things.

Sounds like you have boyfriend issues?

Let each other cool down for a day... Stop the drama...  Be adults about it.

Let someone know and be clear you aren't interested in being talked to that way, I'm sure he will grow up unless he is a loser.

If it is a he... I mean it could be a she too.

Save the texts just in case it happens it would be evidence in an assault case but at this point the cops wont do shit.  Really though, why don't you just catch this guy up when he isn't ready and start swinging?

Think of it this way:

Assault - Threatening violence or offensive contact on another person
Battery  - The act of violence or offensive contact on another person

You may not go to jail, but it is a crime.  That's why a lot of times you hear the terms used simultaneously as "Assault and Battery."  A person threatened unwanted contact and followed through with unwanted contact.

Because he did physically assault me. He's nuts. And he won't leave me alone, it's been like 2 weeks. I should've went to the cops when it actually happened. I don't like cops though. Stupid on my part.

so assault is threatening violence, while battery is committing the actual violence?

Yes, you are correct.

Assault is when someone tells you they're going to kick you ass.
Battery is when someone kicks your ass.

Typically with assault, there are many things that would fall under this....  A person need not directly tell you  they're going to kick your ass as a simple "Watch you back" can fall under the guidelines for assault.  It varies state to state, so you may want to check your local laws beforehand.

Look, no one likes cops, but believe it or not they are actually there for when we need their help.  If this happened weeks ago, there is nothing you can do now.  You should have taken action immediately especially if you physical well-being is at stake.  The best thing you can do right now is to probably file a restraining order if your intention is to try to get this person in trouble with the law the next time they harass you.

I would also recommend completely ignoring the person that is bothering you.  If you have already asked them to leave you alone, that is all you need to do.  It should hopefully deter him if he knows what he says has no effect one you.  If he tries to come after you again after you have politely asked him to quit and have not been speaking with him, it may be considered an attack without provocation.  Different municipalities have different laws, so like I said, check your local laws.  Also, do not tell this person you are seeking help/advice from police if he continues to harass you.  You don't want to give away your strategic position in this delicate matter.

Good luck with everything!

thanks for the advice! :peace:

Hopefully this won't go any further than it has to, but at least I know what my options are now.
