Yes, you are correct.
Assault is when someone tells you they're going to kick you ass. Battery is when someone kicks your ass.
Typically with assault, there are many things that would fall under this.... A person need not directly tell you they're going to kick your ass as a simple "Watch you back" can fall under the guidelines for assault. It varies state to state, so you may want to check your local laws beforehand.
Look, no one likes cops, but believe it or not they are actually there for when we need their help. If this happened weeks ago, there is nothing you can do now. You should have taken action immediately especially if you physical well-being is at stake. The best thing you can do right now is to probably file a restraining order if your intention is to try to get this person in trouble with the law the next time they harass you.
I would also recommend completely ignoring the person that is bothering you. If you have already asked them to leave you alone, that is all you need to do. It should hopefully deter him if he knows what he says has no effect one you. If he tries to come after you again after you have politely asked him to quit and have not been speaking with him, it may be considered an attack without provocation. Different municipalities have different laws, so like I said, check your local laws. Also, do not tell this person you are seeking help/advice from police if he continues to harass you. You don't want to give away your strategic position in this delicate matter.
