I wouldn't sue.  It'll just end up costing you more money in legal fees and chances are you still won't get anything from her.  If it's any consolation she'll probably lose her license... at least in my state she would.

When I was involved in my accident, I got a free consult from a lawyer. I straight up told him that if - for some ungodly reason - we lost, I wouldn't be able to pay any of the fees.

It was a very clean cut case, and he amended the documents during a second meeting. I'm assuming if the lawyer instantly views it as a win, he or she will be willing to do this as well.

Good luck, glad you're not hurt. Do give it a few days, however, and take as many pictures of your vehicle as you possibly can. Looking back, I would've held that day's edition of a newspaper in front of the damn photos too.

Sometimes injuries won't immediately kick in.

Also, remember this: lawyers settle because they don't want to do additional work for money they might not get. Never settle. It's just quick money for them and they'll never have to see you afterwards (with no recourse available on your end if something surfaces).

I didn't have to pay a penny up front, regardless. They had already processed paperwork from my car and health insurance. Also, he had already reviewed visitation records.

sucks, but atleast your not fucked up. my friend got hit by an illegal mexican immigrant and his back is totally ruined. He tried to argue with my friend by saying the light was "blue".

long story short he went back to mexico and guess who got stuck with medical bills and car repair.

Just because a judge awards him a settlement
does NOT mean that he will get his money

If she is drawing some kind of government assistance
then they can not garnish her check.....
