Insurance guy up my bum

So all this crap has been going on with insurance adjusters since THAT OTHER GUY'S ACCIDENT IN WHICH HE STRUCK ME, but I got a call the other day. I've been seeing my doctor about pain, and he said if it still hurts, to get x-rays. I told him all this information.

He asks if I'm getting a lawyer. Of course, I say I don't know. My shoulder/back area legitimately hurts still, motrin + percocet don't help (neither did my last dilaudid :frown: ). Anyhow, the guy tells me he wants to reimburse me for the inconvenience, my medical bills, what I paid for the painkillers, etc. etc.

So, do I take the money and run in hopes down the line I don't need surgery (I'll know more Wednesday)? I'm keeping my mouth shut until I see the doc Wed. and get X-rays.

I don't wanna be that guy that sues for like whiplash and shit, but my back/shoulder's been so messed up I have to like lean to my side to put jackets on. Can't lift overhead still. I think it's fukt.

Anyone been in a similar situation? Anyone work for an insurance company? Do they pay out like a flat rate or take everything in consideration and do like a barter system? I've been told I can refuse his offer, as he's trying to secure his company from not getting their pants sued off of them. Mind you, the guy hit me from behind at nearly 50mph.

id sue the sheet outta him. so his insurance will go up for a long time, mabey he will watch where he is going from then on.

If you got a for real injury from the accident then you deserve to be paid well, that's what insurance is for. I say get a lawyer to protect your rights, and absolutely do not sign anything the insurance company may offer, or accept any small pay-offs ,(insulting ammounts usually) and hire an attorney. The attorneys will take a percentage of what you get and it won't even cost you out of pocket to hire one. Go for it dude, you suffered, you deserve it it's your money.

It won't cost out of pocket? I thought there would be an upfront fee for an attorney. Or is that just criminal cases?

No they will take the case on a "contingency", you don't pay if they don't win, and if you do win they take like 30%, though I'm sure the percentage varies depending on what state you're in.

Call one of the many ones you will find in the phone book and make an appointment for a free consultation, the law also says lawyers have to give a free initial consultation too. I think in all states but I could be wrong.

np man, I can't stand how insurance companies always try to get people to accept small token payments. As far as I'm concerned they are outright ripping off people of money that they deserve, through fraud and deceptive tactics, at a time when those people need that money the most. Unfortunately the law must not see it the same way. :thumbdown: So I always make sure to tell people what those insurance companies are doing. Good luck with that and I hope you heal O.K. :thumbup:
