The cop who ended up dead is not the issue here.  When this guy wrote the song, he threatened to kill a cop.  He also talked about another cop who had already been killed in the same song apparently.

That's not a good example because there is no direct threat being made.  GTA is obviously fantasy. 













It's only a matter of degree.  GTA is modeled after real cities and glorifies the murder of their police forces.  Music is only slightly less in the realm of fantasy than video games.

The fact is that if this man did not intend this song to be heard in a public forum, he did nothing illegal.  It is not a crime to say to yourself, "I plan to kill so-and-so."  Intent to actually commit the act must be shown beyond a reasonable doubt.  End of story.

No, that other murder had nothing to do with him.  He was just referencing/making light of it, I guess.

No.  The rapper who recorded "Kill Me A Cop" was only referencing another cop murder, which had been solved.  He had nothing at all to do with that killing.

so both cops, were both dead, and he said " i wanna kill this cops name"???  well that changes quite a bit then im not sure why that took so long to come out.  when someone mentioned the cop didn't matter they failed to point out that the guy was already dead i guess having 2 cops in the same song can get confusing.  if this is indeed the case im really surpized you guys bothered to argue all my points :lol:

but for future reference, if the cop had been alive?

and then take this back to my question about blowing up the police station what should the cops do if they know before hand?

That gives the officer probable cause to investigate the individual.  It might suffice to bring the person to trial.  At that point, the intent to blow up the police station would have to be established beyond a reasonable doubt for that person to be put in jail.  Beyond a reasonable doubt means that it is certain that the note was not written in jest, as a form of entertainment, and a number of other parameters.  If someone wrote that simple sentence on a piece of paper in the privacy of their home, that is not nearly enough to warrant a conviction.

if you visit our security forum you will see this is how our laws actually work.  anything can and will be used against you.  you think a jury is going to want someone thinking about blowing up builds free on the streets?  or even joking about doing it?  there crazy and at least deserve to be in the loony bin till they pass tests

Locking people up for talking about a crime.....next they will lock people up for talking about growing mushrooms............He made a song about commiting a crime......we make posts about commiting a crime...keep that in mind when you try to rationalize this as a major death threat......he made a threat of commiting a crime,just like you saying I plan to grow mushrooms is a threat to committ a crime.

Besides that just saying something is no grounds for criminal action....you have to have plans and others involved for it to be conspiracy.


Me saying I am going to rob bank of america and kill joe blow the cash clerk is not a plan and no crime has been committed.



Also a rap is fantasy too.......like any of them broke rappers are doing anything they show in the videos and write down in lyrics.....song is a fantasy medium too.



The next thing that is going to happen is they will lock you up for sedition here soon,lockin this rapper up is just step one on that road.


Just keep in mind ,when you say I am going to kill that stupid tweeker named _______ for being late or not paying you on time ,you are just as guilty as that rapper who is sitting in jail.


This is just plain bullshit and clear rights violation,even though I dont agree with what he said or like it .

You obviously do not understand how the law in the United States works.  The burden of proof is on the prosecution - "innocent until proven guilty".  The defendant in fact does not have to prove his innocence, he only has to demonstrate that there is a real possibility he is not guilty.  The prosecution must prove he is guilty, which technically means they must have 96% or more of the total evidence in their favor.  Under the terms of the law, a conviction based on anything less than that is not a fair outcome.
