I hate to say it, but unless someone can talk me out of it, I agree with the cops on this one.  He did specifically mention one cop.

I'm sure that there was a little revenge motivation involved too, since the rapper had apparently made fun of the shooting of another cop on that force who died. 

I still wanna hear the song.  I can't find it anywhere.

But the critical point is that there is no evidence the rapper intended the song for the public.  Someone else distributed it. 

By supporting his imprisonment, you are saying that if I sit here on my laptop, get out my acoustic guitar, and make a little recording that says, "I'm going to kill me ____________ (name of famous politician)" I should be put behind bars.  I find that disturbing.

thats conspiracy for murder, but like i said the part that irks me is that saying the exact same thing about a group of people is ok??? thats what doesn't make sense.

Conspiracy requires multiple parties.  This is literally just one man talking to himself through a digital medium.  Also, the context is such that there is more than a reasonable doubt that he said what he said as entertainment rather than as a serious threat.  I can think of many lyrics of popular songs that, if taken as literal facts, would constitute serious crimes.

well songs hold more than just entertainment value, they also pass on beliefs and idea's.  sort of like a martin luther king, except if he was trapped in our moderan day he would be forced to use "entertainment" rather than be fried by our microwave "riot" weapons.

purhaps the reason why he was locked up was because he didn't release it, so hence it couldn't even be declared entertainment but more as a digital diary of a plot to kill someone hence conspiracy for murder, and if it does require multiple parties then poof you have them as soon as someone else listened to them.  even so if only one person talks about killing someone they deserve to be locked up.

No.  That's not why he was locked up.  He was locked up because the song was distributed on somebody's site, even though it was without his consent.

I disagree.  There must be some kind of demonstration beyond a reasonable doubt that there was a real intent to actually carry out the act.  Hip hop has a history of pushing the envelope on violent lyrics, because of much early hip hop being a form of protest against police and judicial discrimination against African Americans.  It is entertainment with a political message, but it is meant to provoke and not to demonstrate intent.  Nobody thought Ice-T was going around blowing up police stations. 

If people are locked up for what they say it's a violation of one of our most basic Constitutional rights!

Here are some scenarios:

You say aloud to yourself, "Man, I want to buy some weed from Pete Sanchez, my weed dealer."  A police officer overhears.  Should you or your friend Pete Sanchez be arrested?

You and your friends write a joking song about killing your annoying history professor.  Should you all be arrested?

You drunkenly complain to a friend about being broke and say jokingly, "We should rob that bank over there."  If a cop rolls by right as you're saying this, should you be arrested?

IMO in all of these scenarios there is not enough evidence of serious intent.  It would be fair for the police officers to investigate these cases further, but none of these actions warrant any kind of jail time.  I think in this case intent was assumed on the part of this rapper because of his image, not because of substantial evidence.
