legalize it, or tax and regulate it?

So I was having this discussion with a friend the other day, and basically, I feel like advocates of legalization should stop using the term "legalize" in regards to marijuana and other substances and start saying "tax and regulate." I mean, to people who understand the ridiculousness of the drug war it doesn't make a difference, as they already know any so called "controlled substance" has less control on it than any legal substance, but when you're trying to sway people who still have the "drugs are bad/just say no" mentality, the term legalize, in their minds anyway, implies just doing away with all restrictions on the substance and allowing people to basically just go crazy with it. Which obviously would not be the case if it actually were "legalized", but your average media brainwashed American usually doesn't give much thought to to the flaws and consequences of the drug war and just assume legalization advocates are just dope heads trying to get their fix or tryin to sell it to their children or something. The term "Tax and regulate" on the other hand, is self explanatory, and implies maximum control of the substance by the government, and just sounds better IMO. It sounds like a plan rather than just doing away with a law. like I said, we know they mean the same thing but your average American migh not. What do you guys think?

I like "tax and regulate" better since it is less scary for legalization opponents to swallow.

Well, ideally, I wouldn't want marijuana to be taxed.  Of course, conventional wisdom is that if it does get legalized, there will almost certainly be a tax on it.

I bet the tax would be outrageous too!  But with it legal i would suppose you could grow your own maybe?  Either way they would probably tax it so much that most would not be able to afford to smoke it and the ones who did couldnt smoke much cause it would break the bank book.  Thats what they are doing with cigarettes and in turn people smoke less or go broke!

^^I gotta think that the # of cigarette smokers would go down, which would be a good thing in some aspects. I too like to enjoy a cigaratee from time to time (like a rarity), but those 2-pack-a-day smokers might just dissapate if they could kick back with a J instead

even if legalized it'll be taxed and regulated, make no mistake,
most of this country doesnt care about the articulation, they want
to see rights restored, this one is one of them

Your right and i do smoke less when i am stoned on some weed.. i might smoke a joe right after a joint but then im good for a while im so stoned i dont think about a smoke.. i go from a pack a day to a half pack when i have weed.  Not to say my lungs feel any better but it does save me money..

well yeah, like I said, we know it's the same thing, but believe it or not there's a lot of people in this country who, unfortunately as the result of misinformation, still feel like drugs are enough of a threat to themselves and their children to sacrifice some of their rights and personal freedoms to feel safe again. It's false security, yes, cause we know that drugs cause more problems being illegal, but a lot of people don't understand that.

then isnt it our duty to change that misinformation and make it
factual, our government is established in such a manner that
it's ultimately the people that decide, we have the power to
over rule any decision made by the supreme court, any laws
passed by congress and any executive orders signed by the
president

The word "legalize" has turned into a negative word lately. Kinda like how a word like "liberal" has grown a negative connotation over the years. People see "legalize" they think of stoned hippies and Cheech and Chong.

In a serious debate with people who are on the opposite side, "tax and regulate" does work well. But if you're going to a protest, "legalize it" is soooo much cooler on a sign than "tax and regulate"

Probably if it were legalized it would be treated like alcohol -- it would have a tax and license restriction on the SALE of it, but not the production.

If you were against paying a tax you would most likely be welcome to cultivate your own, just as we are allowed to do with alcohol now.

Exactly, we must inform the misinformed. What I'm saying is using the term "tax and regulate" rather than "legalize" when trying to convince the misinformed makes them more likely to actually listen and consider it. Unfortunately,"There some people, that if they don't know, you can't tell em." (I like that quote, I been using it a lot lately) Not to mention, there's still a lot of people who are either in denial or are profiting from the drug war and will argue the other side to the death, misinformation or not, and the media is usually on their side.

I didn't vote because there is no STAL option. 

For the first question I'd say 'tax and regulate', for the second I'd say 'decriminalization'.

There is so much resistance for decriminalization that it's going to take a while to convince the stubborn to accept that billions of dollars earned is a lot better than billions of dollars spent.

They don't give a shit about taxation or regulation, all they care about is themselves.  They don't see that decriminalization will kill the marijuana black market while potentially providing unemployed with various jobs from cultivation to distribution to sale as well as rehab technicians(or whatever you call them).  Shit, hopefully some day THC or cannabinoids in general will be in ERs alongside opiates and amphetamines.

decriminalization is a different concept entirely, decriminalizing marijuana simply means it would remain illegal but possession would no longer be an arrestable offense. it would be the equivalent of getting a speeding ticket. it still wouldn't be legal to sell, so it would have little impact on the black market. If anything, it would probably result in an increase of black market sales, as the the risk of trafficking and distributing would be reduced and more people would be willing to risk it to make some quick untaxed cash. So the way I see it, If your gonna decriminalize it you might as well take the next step and tax and regulate/legalize it. Why allow tax avoiding criminals to prosper while honest Americans suffer? Especially in a time of economic crisis.
