marijuana is legal in canada?

did anyone else catch the short new emery video on pot-tv.net where marc is saying that there was some court case in canada (PEI i think) that is basically being used as case law by some provencial governments as justification to stop arresting anyone for possession or use??

i would post a link, but for some reason my realplayer isnt working, so i cant figure out which video it was in. soon as i get it working and find out ill post a link.

i was under the impression that marijuana was just de criminalized in canada...
of course i dont live there so i dont know

no, its not decriminalized at all.

what i am referring to is a very recent case handed down by some federal canadian court. apparnetly, some guy challeneged his arrest for possession, and finally got it overturned. so the current situation in canada is that some provinces are siding with this new case law, while others are siding with the statutory law.

any canadians out there who can help?

it needs to be legal somewhere, I get busted for a third time, then it is a felony, just for little one hit part of a bud, shit even a seed is considered possession, or a stem.
But I live in Utah..fucking bastard ass laws!!

it is decriminalized in California and in many other states..decriminalized doesnt mean it is totally legal though. even in Amsterdam it isnt totally legal, it is decriminalized.

uhhhh to FL acid: possession of up to 30 grams is decriminalized in quite a few states. check out norml's website. this page should answer all of your questions...

pot may be decriminalized in Ohio, but check out the penalty for paraphenalia... a joint is paraphenalia in Ohio so it still sucks there

Decriminalization: The state has decriminalized marijuana to some degree. Typically, decriminalization means no prison time or criminal record for first-time possession of a small amount for personal consumption. The conduct is treated like a minor traffic violation.

i was under the impression decriminalized meant if you got caught with pot(any amount) they couldnt punish you, just confiscate it.

Subsequent court rulings have upheld the 1975 decision, but the state's high court hasn't ruled on the matter, so the law remains ambiguous.

What does it mean to decriminalize possession? Decriminalization treats the possession of small amounts of marijuana (such as 1 ounce) as a civil, rather than a criminal, offense. Offenders are given a citation and fined, and their marijuana is confiscated. Possession of larger amounts is still a criminal offense because it implies an intent to sell. (The laws differ from state to state. Ohio, for example, decriminalizes possession of up to 100 grams, or 3.5 ounces. Click here for a state-by-state guide to marijuana penalties.)

Legalization, as opposed to decriminalization, would create a legal, regulated market for marijuana, presumably with age limits and quality controls similar to those placed on alcohol. Decriminalizing possession is also different from the decriminalization of "medical marijuana," which allows patients to use and sometimes cultivate marijuana for therapeutic purposes, with the permission of a doctor.

no, the paintings would have gotten replaced by the clubs from this year. It was NORML club at the U. There used to be weekly meetings and monthly house parties (which were unbelievable), but organization was not the strong point for a bunch of potheads. There is still a NORML chapter in the area for the state, but no one is active on campus anymore.

I'm Canadian, and as far as I know weed isn't decriminalized, but you can have up to, I think right under an ounce and all they can do is stomp it into the ground and slap your wrists. Oh yeah, and if your under 18 living with parents they will phone your parents about it. But say you had an ounce all in seperate bags like in eigths or twenty bags or w/e, they might suspect you of trafficking then you might catch more shit.. peace.
