Fiske V Florida....

Okay, I recently moved to Florida. Ate 3.5 grams of dried cubes (Nice Blue Bruising and a lot of it!) Had the craziest experience in my life (Will write about soon, also been two years since i last tripped) I then looked up mushrooms on erowid.org while coming down off my trip (Love those guys at erowid!!)... So let me get this right. According the Fiske VS. The State of Florida, being in possession of fresh psychedelic Mushrooms is PERFECTLY LEGAL in the state of Florida. all i gotta say it there for eating in my salad, spaghetti, pizza, etc. and claim that I do not know they are psychedelic?? am i right??

Fiske v. Florida means that they need to prove that you know what they are in order to be prosecuted.  That is actually the case with all drug laws in the US - Knowingly possessing the substance is an element of the crime. 

So you can pick lots of random mushrooms (in any state, but especially in Florida where there is supporting case law) and if you get a few psychoactive ones in your bag they won't convict you of having them.  If you have a drug record or a large bag of just hallucinogenic mushrooms its less likely that you will get off, but still likely in Florida.  If you admit that you know they are hallucinogenic in any state you can be convicted of drug possession.

Yes, very much so.

When picking actives its always good to pick lots of edibles and/or toxic ones too (in separate bags) so you can calmly explain that you were going to take them home and identify them using books/internet.

Also if someone asks what you are doing its best to tell them you are hunting mushrooms, because if you say some other crap they are going to know you are lying and something is up.  Some people pick edible/toxic mushrooms all the time so its not that weird.
