remember that in the state of florida the possession of fresh psilocybes is not unlawful. this does not mean you will not get arrested for picking them. it only means that the courts have rules (Fiske Vs. State of Florida, 1978) that you can not be convicted of possession of a controlled substance for gathering fresh psilocybes.

If a cop catches you walking around some field with a bag of mushies, you'll be able to plead in court that you thought they were edible and get off possibly. If your caught walking around town with em' your busted and going to jail for possesion.

The last I heard, the state of Florida had NO laws concerning cubensis mushrooms. Unless they've passed new laws, sean is right. It's the only state in the country without such laws.

The Laws against having psilocybin are federal laws. It is a schedule 1 controled substance, and you could get 10 years if you want.This is the last that I am say to the uninformed regarding their misconceptions of reality. It's time to go back to my old signature- Those who know don't say,

in the state of florida it is not illegal to gather fresh psilocybes, it is however illegal to dry them being if you dry them you are "processing" them and that is a federal crime. but fiske vs state of florida makes sure you can not be convicted for harvesting fruits, look it up!

The state and local cops cannot arrest u for shrooms in florida. They cannot enforce a nonexistent law.
The FBI, BATF, Secret Service,federal Marshalls, or DEA could arrest u for the illegal chemicals contained in the shrooms, but what are the chances of this happening?

I thought the law was that it was legal to have them growing on your property. Mushrooms have psilocin and psilocybin, both schedule one and therefore illegal. San Pedro also contains a schedule 1 substance but is sold in stores. I guess it's a pretty grey area, but I'm pretty sure that if a cop really wanted, he/she could arrest you for having mushrooms, dried or fresh.------------------

Man it goes like this>
tresspassing=illegal
picking ONLY cubes=illegal
possession of ONLY (esp. dired) cubes=illegal
possession of or gathering all different kinds to take home to identify for a science project=all good
its so jony shroomhead who picks only cubes gets harrassed. Grandma or College student picking what is thought to be edibles or "just a slice of the natural habitat" can say oh i had know idea mister ocifer geez thank for warnin me good thing i didnt eat that ONE HUH

you do not have to tresspass to gain access to a field you can ask permission, i have tresspassed but i prefer to ask.ask them about fiske vs state of florida

The best way to settle this is to go to erowid.com, click mushrooms, click laws, then go to state laws and look up FL. That should surely solve it. Ya know what, i'm gonna go do that right now.

Ok, i'm back. Here's all it came up with."It has always been said that Florida is lenient when it comes to Psilocybin Mushrooms. From reading thru the statues either something has changed or I just can't locate the info everyone is referring to. Psilocybin is listed as Schedule I and has just as staunch a punishment as most states." I forgot the cut the part about wet and dry but there both a schedule I substance. Says there lenient about it but still, none the less, there both still illegal.

GGreatOne, well as long as you are going to ask, can you ask them if they are legal for religious purposes, and what proof you must have to show that they are for religious purposes? Also, ask them what steps you must take to declare them as part of your religion.------------------

When I first started growing mushrooms I bought a book called "Mushrooms and the law". I bought it because I wanted to know the ricks of what I was doing. While I don't have the book now, I do clearly remember the part about claiming mushrooms as a part of your religon. It doesn't work from what I remember. Mushrooms, in the U.S, are just plain illegal. The religon thing just doesn't work.
