do you know you can abuse patents

people do this
for example
this company spends like $10,000 to develop genetically engineered corn that survives freezing temperatures
then u patent that gene
then if any farmer has that corn on their field they are subject to a fine no matter how the corn got there
so you can go around with seeds planting them everywhere and then fineing every1
farmers are really pissed about gene patenting
its ridiculous

Would you happen to know any cases of this actually happening?

If you have an ultra-rare, non-natural strain of corn then it would have had to arrive in a field somehow.  Does the company claim that the farmer forcibly broke into some type of storage facility and stole the seed?

Watch the video Pris posted.  I was gonna post the same thing.

It's not so much people sneaking in and planting their seed or anything like that, it mostly affects people who grow their own seed.  Pollen from the genetically altered plants gets blown into the independent farmer's field by the wind and pollinates his field, passing that patented gene on to the seed, which causes the seed to belong to the owner of the patent.  If they find the gene in the FINISHED CROP (the farmer's spent all year working it) it becomes the owner of the patent.  It's ridiculous, the FDA is a buncha crooks.

It sounds like a good solution would be to require genetically engineered seeds and crops to be sterile.

I'm not necessarily against patenting genetically engineered crops, but I don't think its reasonable to patent a single gene that can be passed through generations.

Yeah that is kinda fucked up. If only a few of your plants out of all of them have that gene, they shouldn't be allowed to fine the person.

I agree with badchad though, GM crops should be made sterile so that they don't contaminate other crops or the wild type. My biggest fear with GM foods is that the GM gene will spread to the wild type and abolish the original genotype. That'd be fucked up.

Not all GM foods are bad though, they can be used for good. I had to write a persuasive speech for a public speaking class in favor of GM foods. If you wanna read it take a look here:

Or, the courts could go back to their original stance and say "fuck you, you can't patent living things".


I really don't think that this will continue.

Eventually, once judges understand how genetic engineering works, they will see that this is obviously abuse.

it's a big concern of mine, I dont grow anything that's grown by
some of these larger farms, we have one that does wheat, soy
beans and corn and I've seen him spraying roundup, running the
seed and having to put nitrogen into the soil, I'm really
selective of my seed sources since the acquisition of Seminis,
they were the leading supplier of organic seeds to most other
seed distributors

it's civil litigation, not criminal, the burden of proof for
monsanto is little more than showing the DNA is present, there
doesnt need to be a motive. anyway, their game is to simply out
money you, they could buy land across the street from me, their
shit cross pollinates with mine and I'm liable because the laws
are not clearly defined and policy is being written by employees of
the company that happen to like bouncing between the FDA/USDA and
Monsanto
