Obama's bill Creates HIV Positive Database

The stimulus bill currently working its way through congress came out with an interesting addition. Everyone's medical records will go into one, massive government database. What does this mean? The government will have a handy list of:

every person that has tested HIV positive,
every person that has full blown AIDS,
every person that has gone through drug rehab,
every person that has undergone mental treatment,
every person that has had an abortion.

The reason given for creating this database is to save money on medical costs. I'm sure it will, simply because questions like "Do we need to spend the money to perform heart surgery on this person that has tested HIV positive?" will become common once this database is created.

No, but if the Government starts keeping a huge data base on everyone's personal private medical records i will use the information just like a background check.

I've seen no reason so far that this should have any less confidentiality attached to it than your other medical records. HIV tests are expensive... as I can see this is the reason for this.

I think it's odd that they are keeping track of everyone who's had an abortion though. Most of those other things are already in some archives somewhere, though for some reason aids (the most deadly and painful disease) was given special legal treatment.

yeah keeping track of the abortions doesn't make sense to me. i can also see a lot of people getting screwed over on the "mental treatment" front. a lot of people go on antidepressants for short periods of time without fully understanding the lasting consequences of their treatment. i mean, you already are barred from government positions if they discover you had depression in their background checks...this will just make that kind of discrimination even easier.

i don't want a big red flag on my health records that says "this guy's unstable! beware!" because my parents decided to throw me on antidepressants for a few months when i was in high school.

Senor_Doobie is right. A central database will make it easier for your doctor to get your records, but it doesn't mean that just anyone will be able to see them.

Who's worried about anyone?  We're worried about bosses and buisnessmen, not the guy on the street.  I don't care if the guy on the street knows about it, in fact.


THis is crap and a half.  Why the fuck do we need this?  Everyone can keep their own records if its important to them and if it isn't they can toss them out.


I want to opt out- this is bullshit.  I for one will definitly start lieing to doctors.  Before you could transfer docs and not have shit follow you.  Now its impossible. 


Be prepared to be laying in pain in the hospital if you've ever told a doc you've used LSD or vicodin illicitly. 



This really, really upsets me.  Fuck you obama.  IF its for my benifit, let me opt out.  I see a trend..... lots of things the government does are for my benifit.  But I don't want them.



Here's a question:  How the fuck can you have a right to kill a fetus but not to the privacy of your medical records under the constitution?  I don't fucking get it- and I'm pissed.

Bosses and businessmen are "just anyone". They aren't doctors. They can't see your records. If they could see your records under the new system, they'd be able to see them now as well. It wouldn't be any more difficult.

Why? Why would a doctor care, and more importantly, why would that preclude him from treating you - particularly if you're paying him to treat you?

You don't want the patients to have a right to see the records?  If we give the patients the right to see the records we ipso facto give the buisnessman and bosses that right- as well as the govenrment.  Your boss will make you permit him to see your records for mandatory insurance review- as is done now.  Only now you can tell him you have no doctor or give him your pediatrician many years back.  With a national database that would be a neat trick.  If the rights to access are nontransferable then the boss will just make you submit the summary sheet detailing all the doc's who've got your records and ensure you've signed releases fro all of them where he will then procede to access them directly.

Same with the government or if you're ever sue or are are sued with health or mental health of relevance (said you were upset and that caused damage?  Fork over those records).

It is not cool.  This will make it difficult to hide shit that is your private buisness.


But if you support this system as long as it is accesable to doctors only why can't I see my own records?  Either way it is bad news.


Imagine trying to get a "drug seeker" or "possible schizophrenic" or "difficult" or anything else out of your record now? 

When you're laying in bed in pain be sure to remember I told you that you shouldn't have told the nurse and doctor you've used drugs.

No medical records aren't, that's the whole point.  It is ridiculous that the ninth amendment is read to include killing fetuses but not medical records.  Total bullshit.

Why would a doctor care?  Cuz he's ensuring he doesn't break the government rules and get thrown in jail for drug dealing.  He's ensuring he's not giving maintnance treatment to an addict- which is illegal.


Mostly cuz he's been taught and in a culture his whole professional life where patients are drug seekers and they are the parents who have to deal out pain and comfort carefully.  Docotrs are incredibly paternalistic and will decide you are a drug user and get no drugs- that simple.

This to me just seems like you're using a technical solution (ie, non-electronic records) to fix a social problem (ie, that employers are assholes).

I just can't imagine ever having to give my boss any sort of medical records. If my boss demanded that, I'd report him. That's way out of line.

I'm sorry I must have explained my objections poorly.  I am not against electronic records.  I am against the government having all of our records with no opt out, no "I'll pay myself, thanks", no choices at all.


If the docs want to digitize, as they all seem to do allready, then fine.  I just don't like the govenrment having them all so they can do what they want.


I choose who I see as a patient.  And I choose based on who I want to tell my medical problems too among other things.  I wouldn't go to someone who I knew gossips, and I wouldn't go to someone who I knew puts his records in insecure databases.


Only now I don't have a choice if Obama's plan goes forward- I take it no matter what.  No choice to say "I'd rather not go to that doctor".  Of course all this will depend on the final version, but as both a slippery slope and as a fundamental problem inherent in these schemes: I think its a bad idea for privacy.



You may not imagine giving your boss records, but it happens.  And you may not want to believe docs in america at least will make patients suffer because they never know if the patient will 'abuse' the drugs after their surgery or if they are really in 'that much' pain- but it happens, and it happens a lot in my expeiriance.

After the things I've witnessed I'll never tell a doc I've ever used any illicit drug (cuz somehow there's a distinction between liccit and illicit).  I've told my family to do simmilar, and my dad has a friend who used to be an ER doc and advised him of the same thing.


Paternalistic medicine sucks, but it exists.

Fair enough. I guess it depends on the specific implementation. I'll be interested to see how it develops.

Not really, when the US Federal Government is involved.  I can already see law enforcement drooling over this... a data mining gold mine.

This idea is wrong, but it goes in line with the socialist doctrine that we have embraced in Obama.
