Nebraska Moves to Ban Salvia Divinorum

Attorney General Jon Bruning today unveiled his legislative package for the upcoming 2008 legislative session.

Bruning’s 2008 legislative package includes three bills. The first seeks to protect Nebraska kids from a dangerous drug known as salvia divinorum.

Salvia – This bill protects Nebraska kids from a dangerous drug called salvia divinorum by making it illegal. Salvia is an herb native to certain areas of Mexico and it’s an intense hallucinogen that’s increasing in popularity.

“Salvia is a powerful hallucinogen that can be purchased legally. This legislation will make it illegal and put it on par with other powerful drugs like peyote, psychedelic mushrooms and LSD,” said Attorney General Bruning. “Several other states have already made salvia illegal. It’s time to add Nebraska to the list.”

The bill adds salvia to Schedule I of the Nebraska Uniform Controlled Substances Act. Possessing salvia would be considered a Class IV felony with a penalty of up to five years. Trafficking the drug would fall under a Class III felony with up to a 20 year penalty.

“Videos of teens using this common plant to get high have become an internet sensation,” said Sen. Vickie McDonald of St. Paul who’s carrying the legislation. “Nebraska needs to classify salvia divinorum and its active ingredient, salvinorin A, as a controlled substance in order to protect our children from a drug being portrayed as harmless when it’s not.”

Why did Nebraska indefinitely postpone the bill?  To bad Ohio is so freaking lame, really; they want a HUGE prison population to get more money and look like they have serious problems...which they do and just make more......going to pass Cali one of these days.  With so many kids from out of state going to college in Ohio, there will be not much purpose for banning things that are not banned in a close state or someones hometown....college kids move a lot of stuff and aren't all worn out by shady dealings.

Its strange. Nebraska, for all its backward rightwingness, has a more relaxed view of drugs sometimes. Less than an ounce of weed it decriminalized over there.

Wikipedia apparently does not update their information as frequently as we do here. They are referring to a bill from January '08 which never reached a final vote.

This is a new year, new bill. They just don't give up.

Well, yes we can see a change that is absurd to us as the change that we enjoy from drugs being absurd to them.....the species has never been so restricted from drug use.....it got us just here as a species just fine......why change a good thing (because others disagree and that is disheartening).

It would be wise to separate the use within society than trying to think you can separate from society.......that is why it worked in the past.....and only why.

Powerful drug...they always say that.

WHAT THE FUCK DOES THAT MEAN? How exactly does one go about gauging the "power" of a drug? And which drugs aren't powerful?

And why don't they just go ahead and change the definition of drug to include being dangerous and save themselves some ink and paper, because I'm getting pretty damn tired of hearing about that too. Everything they talk about is dangerous. People could start snorting fuckin' pixie sticks and they'd call it the "dangerous new drug craze". Idiots...

Actually, that's not correct.  I live in Nebraska and I have not seen any decriminalization of any drug.

Wow...they're really "protecting" people by throwing them in jail so they have no future.

This makes no sense. Of course, the entire war on drugs makes no sense at all...but oh well.

Users of salvia defend it to Nebraska lawmakers

LINCOLN, Neb. — Scott Ferguson of Lincoln told state lawmakers Wednesday that he's smoked or chewed the plant Salvia divinorum a dozen times in the past five years, and called it "a unique visionary substance."

He disagreed with those who said it was dangerous, and he said a law banning it was premature and unnecessary.

"Before we ban nondescript houseplants, we've got to step back and take a clear look," Ferguson said.

But Assistant Nebraska Attorney General Corey O'Brien told the Legislature's Judiciary Committee that salvia is a fast-acting hallucinogenic drug similar to LSD. He said it can make people dangerous to themselves and others.

"It also gives many a very bad trip," O'Brien said. He told lawmakers that nine states have already banned the plant.

State Sen. Russ Karpisek of Wilber has introduced a bill (LB123) making it a felony to possess or sell salvia. Possessing it would be punishable by up to five years in prison; selling it, up to 20 years. A similar bill didn't reach a final vote last year.

Salvia divinorum is generally smoked but can also be chewed or made into a tea.

Called nicknames such as "Sally-D," "Magic Mint" and "Diviner's Sage," salvia is a hallucinogen that gives users an out-of-body sense of traveling through time and space or merging with inanimate objects. Unlike hallucinogens such as LSD or PCP, however, salvia's effects are shorter, generally up to an hour.

Recently, a store owner stopped selling salvia after state officials ticketed him for selling the plant at his Lincoln store, Exotica.

Officials said Christian Firoz violated a statute that prohibits the sale of substances that will be used to induce intoxication.

Karpisek said salvia is a "gateway drug" that can lead to other drug use.

"What is the difference if it lasts all day or just a few minutes?" Karpisek said.

No known deaths have been attributed to salvia's use. It is not the same as the ornamental plant known by the same general name and is easy to purchase through the Internet.

Steven Glaser of Lincoln told senators it's a nontoxic, innocuous plant that can be useful as a painkiller.

And Ferguson, also of Lincoln, said that while people under age 18 probably shouldn't be allowed to purchase anything meant to be smoked, "adults should be able to interact with salvia."
