So you got arrested, so what? Untill recently you could be arrested in Ohio for doing 36 in a 35, doesn't mean its a big deal, or endow you w/ knowledge.


And I don't see how my personal involvement, or lack thereof, with the law is relevant.

If you are as upset as you seem to be, it would behove you to find what you were charged with. Felony drug abuse encompases a plethora of possible offenses, none of which appear to me to constitute a felony under your stated situation, unless you were charged w/ sale for money of that 5g- which you didn't state.

So figure out what law you were charged with, or since you seem to say you're knowledgable about htis situation, find the section of law that constitutes a felony under your attendant circumstances, and would consitute a drug abuse offense.

btw. I meant to put an "or" in my list of explanations, so I wasn't saying that you were necesarily confused, just that that could explain the situation

I saved all the paper work from the event. I know what I got charged with....I mean come on.

I'm DEFINITELY not confused.

I was charged with felony 5 drug abuse.

You can argue all you want. Look at all our state laws. And keep telling me how wrong I am. However I know for a FACT what I was charged with....felony 5 drug abuse....why would I go look it up when I already know?

Like you said....cops lie.

You also aren't supposed to get cuffed and thrown in jail for possession of marijuana.

I was.

He searched me, I lied said I didn't have anything, he found it in my shoe. He told me I was going to be arrested if he found anything else....which he did on my girlfriend ( who was searched by a male ) and it was roughly 2 grams.

He said since " we wern't honesr" we were going to jail.

He took us to county, they said " we can't except these people, their offense is nothing more than a speeding ticket".....The cop says " I've brought people in here for speeding tickets"

That jail wouldn't take us.

He called three other cities within the county til he found one willing to take use.

I had to post 500 dollars bail ( 250 each ) and was charged with.....once again.....felony 5 drug abuse.

When I asked if you've ever dealt with the law in ohio, what I meant was, you can get FUCKED.....like you said cops lie....

Yep, cops lie, are dumb, all that.

What I'm saying is Felony Drug Abuse is not a particular crime, it is almost any crime in the drug offense section of the code that is a felony.

So apparently he just wrote down some giberish without figuring out what the offense was.

Check out this:

"(G) “Drug abuse offense” means any of the following:

(1) A violation of division (A) of section 2913.02 that constitutes theft of drugs, or a violation of section 2925.02, 2925.03, 2925.04, 2925.041, 2925.05, 2925.06, 2925.11, 2925.12, 2925.13, 2925.22, 2925.23, 2925.24, 2925.31, 2925.32, 2925.36, or 2925.37 of the Revised Code;

(2) A violation of an existing or former law of this or any other state or of the United States that is substantially equivalent to any section listed in division (G)(1) of this section;

(3) An offense under an existing or former law of this or any other state, or of the United States, of which planting, cultivating, harvesting, processing, making, manufacturing, producing, shipping, transporting, delivering, acquiring, possessing, storing, distributing, dispensing, selling, inducing another to use, administering to another, using, or otherwise dealing with a controlled substance is an element;

(4) A conspiracy to commit, attempt to commit, or complicity in committing or attempting to commit any offense under division (G)(1), (2), or (3) of this section.

(H) “Felony drug abuse offense” means any drug abuse offense that would constitute a felony under the laws of this state, any other state, or the United States."

So any of those offenses could be felony drug abuse if they're felonies. Cops have a surprisingly lite understanding of the law, from what I've seen.

They arrest on suspicion or something made up, and then the prosecutor or sergeant gets to figure out what to actually persue. For a felony, you'll usually be indicted anyways, so the initial charges don't mean a whole hell of a lot, except for bail purposes.

New cops spend approximately three months studying the laws and procedures specific to their jurisdiction. (They spend another three months learning basic/generic "how to be a cop" type stuff.) Based upon how long it takes to become a lawyer, I cannot imagine that a new cop/recruit has time for more than a basic introduction to the laws in their area. Pretty sad when one stops to think about it...

Do they indict on all felonys, and only felonys?

Meaning, that on norml it says selling pot is considered a possession charge under 25 grams. So if an undercover bought say a half from you and that was it, would he have to bust you on the spot or not at all? Or try to get another bigger buy to actually take action?
