Telling the difference between legal mycelium and illiegal mycelium

I really enjoy growing edible mushrooms .. I just started with a shiitake grow log and I want to put some shiitake mycelium on agar, and grow other edibles.
how can law enforcement tell the difference between oyster, portabella , shiitake and any illegal mycelium? is it easy to differentiate between them ? does all it take is a microscope?

To be honest if they didnt know what it was they would probably think it was a drug... Not mycelium

yeah I am sorry I was not nice.. that was a smart ass remark and I am sorry .. what I meant was do they have to do lab tests or can they to on the spot tests...

Well I would assume that even if you don't incriminate yourself like most do, the visual inspection could yield probable cause to seize and test. Anyways, field tests do exist:

In the dea micrograms someone was caught with mycellium and they grew the mushrooms to find out what type they were.

They have a difficult time with it. There are only three routes that I can think of... 1) dna testing. Expensive, and as far as I know, unproven in court, so it would be a very expensive uphill battle for the prosecution. 2) check for illegal actives in the myc. However, most literature claims that there is very little if any actives in the myc before fruiting. 3) try to fruit the myc and identify the mushroom. Again, difficult unless they know how to grow and they were careful not to contaminate while capturing the evidence.

At the same time, you can get screwed over even if you are only growing legal mushrooms. I had a friend that was growing edibles for a few restaurants in the area. A cop overheard two chefs talking about who they buy mushrooms from. Next thing my friend knows, he is being booked into jail as a drug dealer. Between lawyer fees to prove his innocence and damage to his 100% legal operation due to overzealous police, he lost around $30,000. Be careful.

One thing I haven't seen mentioned is that in most areas it is only psilocin/psilocybin that is illegal. AFAIK species are not named in the law, mostly because there are many species that produce psilocybin.

So DNA tests would prove nothing. Unless they test for psilocin on a GC/MS or HPLC they would have no proof of anything. If they grew them out or even let them sit for too long you could easily argue that no psilocin existed in your possession and that the LEOs are the ones that "manufactured a controlled substance". Otherwise what would be to stop them from growing up the spores themselves and trying to bust you?

Fast Fred is right, but the fact that you are growing mycelium could be used to prove that you intended to produce the substance. In my jurisdiction, an attempted crime carries the same penalties as the completed crime, with the exception of a select few, like murder.

Anyways, I'm sure you could detect illegals in the mycelium.

what if you use Hpoo from a local stable in an area of the US where wild cubes are prevalent and as part of growing legal mycelium mycelium from the pasture land Hpoo starts growing cube mycelium?
I would think that would be a good point .. if you didnt pastureize your Hpoo that is .

I always thought so as well, but oddly enough, the few cases that I have read indicate that the forensics labs have a very difficult time doing so.

I can't think of any reason this should be. Unless the lab monkeys (plenty of which in general are idiots- though I've never worked in forensics, so can't say specifically) have a printed flowchart they may not know what to do.

There are plenty of published and non-published procedures printed online, though. As with everything else, the gc/ms is used.

My guesses (I really don't know):

1) mycelium contains very little actives until fruitbodies form
2) they probably don't preserve the mycelium very well before testing
3) not a standard type of test that they are used to doing

I worked as a "intern" in a forensics lab when I was in high school. Pretty much everything that they did, with respect to drugs, was "follow the recipe". They would run a streak test and if any suspect lines developed, they would gc/ms the sample. Anything outside of the norm was likely to be ignored (or messed up) as the lab techs were trained monkeys following a script. This was back a couple of decades, but I doubt much has changed.

Yeah, this has been my experience too. I worked with this one girl who even had a B.A. in chem (wtf?- why bother?) and she was one of these 300lb fattys w/ an attitude that hated all guys- unbearable. Anyways her and most everyone else except the PHD (who couldn't be bothered to do any work) were complete morons. Couldn't add 2+2 if directions weren't in a book somewhere. Wasn't forensics though, just chem. synthesis and purifications

Yeah I was thinking the same thing...testing for psilocybin is extremely expensive....and if its touched wouldn't it bruise? thats one way...if they came across it they would probably seize it and have the labs fruit and if it came up psilocybin it would be fucked

bluing it's not a prove that it's active or that it contains psilocin/psilocybin

but what you can do is take H202 or Alcohol with you if you're going to move your culture and if you get busted mix them together!!!!! NOW try growing that!!

Yeah, now they have another charge, destroying evidence, way to go! (Granted, a destruction of evidence charge may be much better than the alternative.)
