Internet Radio Law Question

Got a q about royalties. Back in the day I was looking into costs and shit for shroomery radio. I'm not sure what the RIAA charges in fees for each song someone is allowed to broadcast... but I do remember there were services for which you could pay a set monthly fee to cover it all.

This royalty.. is it only supposed to be paid to songs in copyright? I hear stations like SOMFM have 10's of thousands of dollars a month in operating costs. I'm sure a big chunk of that is to the RIAA.

So... theoretically if someone was to host an Internet Radio Station... playing either music that has no copyright, or has some sort of expressed concent from the owner, you wouldn't have to pay SHIT for royalties and licensing... correct?

I'd imagine...if its not copyrighted, its public domain, I'd imagine.

As far as consent from the artist on copyrighted material, that would depend on whether they own all of the copyrights, not just the ones for the writing of the music, but for those of the recording as well...

Ja. Well. That's what I'm saying. I'd probably have to go to the recording companies or whoever. If you're playing music that's sort of underground, or not that big.. I'm sure it would be easy to find plenty of music you could get for free strictly to broadcast. Any small label who's smart should know that it's a small price to pay for getting ppl to listen to shit.

I mean.. fuck the big labels anyway. Who the hell wants to listen to garbage. It all works out in the end.

So I'm just saying.. I can't believe ppl like Soma who play "underground" music have such high royalty fees. Lord knows how many cd's I've bought because I heard someone on them.

they're going to sue over that?

except in this case it is the Copyright Royalty Board increasing their royalty rates by up to 1200% for internet radio stations.

SomaFM gets about 3000 listeners at a time on average... That might not sound like a lot. But if you consider about 1 PENNY per listener per song that's played... that 30 bucks per song... about 20 songs per hour. 600 bucks an hour = 14400 bucks a day.

You still think that's small potatoes? That's just *ONE* internet radio station.
