I checked it out deryl, and for the most part, you are right.  However, three states have banned it: California, New York, and Illinois.  Of course I live in one of those states. 
I think maybe what caused me to make the original statement, aside from the stuff being banned in my state, is that the FDA has been trying to get it banned across the country for about the last 15 years.

Not sure this is true, my bro (we live in NY) bought a bottle a few months ago, after ephedrine was hastily taken from shelves. It wasn't for energy though, it had guaifenesin which is a chemical found in many cough syrups that causes vomiting in high doses and was no doubt added as a deterrant for the 8th grader looking for a quick buzz. No matter, I would take 8 of those things and be pretty buzzed. Like 80 in a bottle for 10 bucks! Haven't looked around for them lately but they were OTC
