Canyon Lake man guilty of soliciting boy

SAN ANTONIO ? It was to have been a sick and perverse New Year?s Eve party.

What happened instead was a celebration by FBI agents who arrested a 44-year-old Canyon Lake man and San Marcos school teacher ? who thought he was meeting a 14-year-old boy for sex.

Thursday, David Franklin Benner pleaded guilty in Federal District Court for the Western District of Texas to soliciting a minor for sex over the Internet, a violation of Title 18, Section 2422b of the U.S. Code.

In exchange, federal prosecutors promised him a 10-year sentence. If convicted at the end of a trial, Benner, a former second-grade teacher at Crockett Elementary School in San Marcos, faced up to 30 years in federal prison.

Benner has been held without bond since he was arrested in front of a Giddings coin laundry. On Jan. 10, a federal magistrate ruled there was probable cause to believe he was a ?dangerous sexual predator.?

FBI Special Agent Kristina Sheppard launched a months-long investigation into Benner that began when an undercover officer allegedly found him in an Internet chatroom called ?BOYS WHO WANT OLDER MEN:1? posing as a 37-year-old man with the screen name, ?Fun4uinmetexas.?

Later, Benner introduced the agent to a 14-year-old boy in the chatroom. The FBI contacted the boy?s parents and assumed his identity on the Internet.

During Internet chats, Benner allegedly displayed his genitals on a Web cam and told agents posing as children that he would like to role play sexual seductions where he played a teacher or a coach ? both roles Benner had in real life in San Marcos.

As the chats went on over several weeks Benner on Dec. 3 made arrangements to meet the ?boy.?

When he was arrested, he had two loaded handguns on the seat of his pickup. He surrendered without incident and cooperated with investigators, according to his arrest affidavit.

In 10 years working for the SMISD, spokesperson Dey Rossell reported officials never received any complaints about Benner ? and no evidence has ever been found that suggested any misconduct in the workplace.

?There were 19 students in his class,? Rossell said. ?When we found out about the allegations, we suspended him with pay pending the outcome of the investigation and sent a letter home to parents notifying them on Jan. 5.?

Benner later resigned his post.

Yep, he ain't gonna have a good time in prison, that's for sure. It always amazes at the absolutely stupid ways these pedos get caught. They busted some guy a few towns over for having kiddie porn on his networked work computer! Yeesh! :rolleyes:

Holy Crap!

My daughter went to Crockett for kindergarten. That?s totally fucked up. San Marcos is such an awesome place to live. I never would have suspected someone like that could have access to my kids at that school. Just goes to show that scumbags like that can be anywhere.

rule # 1 never trust any one! Rule # 2 dont go to chat rooms about young boys wanting to meet old guys. Guy gets a prize for the almost darwin award. I go to this nursery and the owner is a perv like that. Feel bad for his family. He creeps me out and im sure it must creep out his wife knowing what he has done. Ok I don’t know where to begin, but David was my family. I know what all y’all
Have read, and seen but I just thought you should know what has become . Shortly after being released from prison David took his own life. I was there for him through his sentence, and tried to be there once out.

  There was a lot that wasn’t told to the public , there was a lot that wasn’t even told in court. The investigators interviewed and dig into his life and nothing was ever found to show any signs that he ever was inappropriate with any kids. The only reason he was convicted of anything was the fact that he had a weapon on him at time of arrest.


After serving his time and getting out , he felt so lost and lonely that he thought he had no option but to take his own life. I was notified only a couple hours free they found him and had to deal with the after effects. This all happened years ago , but recently I was contacted by the local PD that found him and they were wanting to return some personal affects , which stirred all this up for
Me again .
