One more plus for Bali. There are several other reasons why I'd like to visit Bali. Or move there. That 'original kit' place has been around for ages just openly selling them. Don't get me wrong I wouldn't want to walk up in front of a police officer and show them a grow kit, but technically grow kits are legal to buy, but it's still such a grey area when it comes to actually growing them.

Then dried mushrooms wouldn't be illegal either

It doesn't distinguish in that quote between synthetic and naturally occurring.
All that says is that link you were on was only about pure psilocybin and psilocin. They are scheduled separately from dried mushrooms and fresh mushrooms. That quote says nothing whatsover about dried or fresh mushrooms. That is only talking about pure psilocybin and psilocin.

I'm like 100% positive that even being in possession of fresh shrooms is legal. It's when they've been dried is when they become illegal. Basically the argument is that you're manufacturing them for the street. Also trying to sell fresh mushrooms is illegal, but this doesn't mean just possessing them is illegal. At least that's the rumour when I did a quick google search just now.

I'm totally lost I thought psilocybin was the illegal part, mushrooms are irrelevant to the argument really it's just about what they contain, right. No different than marijuana, its not illegal to have weed but its illegal to have thc.

Canada's different lol. There's tons of loopholes like this all throughout the legal system. Like mescaline being illegal, but peyote is 100% legal.

See that's what I'm struggling to understand, is psilocybin illegal or are mushrooms illegal. Peyote contains mescaline but until I cut the plant up to get it it's fine, Kinda like opium poppies are legal here I can buy the seeds at my local market, but once that plant matures and you cut the bulb everything that comes out is illegal.

I get that if you pick active ones in the wild, ok the cop isn't going to know what they are and if they do play dumb  and  act like you thought they were something else. But the law states psilocybin and all forms are illegal, mycelium included. So if you get caught growing them, without drying them it's ok, that's the part I'm stumbling over.

Sorry for ranting I just hate talking about laws that don't make sense, the law is the law and it should only be able to be interpreted one way.

it does not state that exactly. Certainly does not state that mycelium is illegal. It states that all purified forms are illegal essentially is all that law specifically states.

Psilocin (3–[2–(dimethylamino)ethyl]–4–hydroxyindole) and any salt thereof

Psilocybin (3–[2–(dimethylamino)ethyl]–4–phosphoryloxyindole) and any salt thereof

I'm pretty sure that means psilocin, and psilocybin are illegal. Both mushrooms and mycelium contain those substances. If I were to read that that's the conclusion I would come to. Unless I misunderstood what I read, which has happened before, lol.

Again opium is illegal - poppy's are not.
DMT is illegal - mimosa hostillis root bark is not.

Saying the purified form of a substance is illegal is not the same thing as saying every single thing that contains that substance is illegal. Mycelium and spawn are NOT illegal in Canada. In that you can 100% legally buy grow kits.

Saying any salt thereof isn't saying the purified form though. You could have 1% psilocybin in sugar, it still contains psilocybin salt.

The reason peyote is an exception from the mescaline from my understanding has to do with the first nations/aboriginal peoples right to use it

I'm pretty sure that in Canada fresh psilocybin mushrooms are illegal and that the law doesn't anywhere differentiate between the dried or fresh ones. I think the websites that mention that are just continuing false information. It doesn't make any sense.

I found this in another shroomery thread which I found interesting. I do wonder what the law stated before it changed to say "any salt thereof"

https://www.shroomery.org/forums/showflat.php/Number/22156#22156

Quote:
Up to a few years ago, fresh magic mushrooms and cultures were legal in Canada. Unfortunately, since then, a new bill has been pasted, which makes every part of the fungus(fresh or dried) illegal. Fortunately, it is not the mushrooms that are illegal, but the chemical they contain - Therefore, because the spores of these mushroom contain none of the illegal chemicals, the spore are still legal.

Post is 18 years old, lol

idk how many times we gotta say it... MYCELIUM IS LEGAL IN CANADA.
you do a great job of spelling it out Viking.
:hellyeah:

Fresh wild mushrooms might be ok but I'm pretty sure cultivating them is illegal.
This is a disclaimer from one of the main sites that sells mycelium kits in Canada:

I, the purchaser, verify that I am 18 years or older. I understand that the cultivation of Psilocybe mushroom species is illegal in Canada. ************ offers magic mushroom spawn kits for microscopic research, identification, and education purposes only. I take full legal responsibility for my actions in relation to the purchase and use of these mushroom kits. Further to this, any legal actions, suits or matters are the sole responsibility of myself, the purchaser, and not of ***********, any associates of *************** or those of it’s parent company. I understand that the cultivation and use of Psilocybe mushrooms may be dangerous and illegal.

It's totally illegal.

Source: I got charged with production of a schedule III drug (psilocybin) for having pf tek jars.

I was never convicted but that's not because it wasn't illegal. It's illegal.

Are the kits they are selling edibles? Canada is kinda laid back so it's possible dude is selling actual live cultures of cube mycelium and just doesnt give a fuck and probably won't get busted unless he's got a sidegig pressing fentanyl into fake oxy on the side or some shit

Hey friend, mind me asking how this happened ?
I also grow and live in Canada, I wouldn't want the same to happen to me !

Re: Is cube mycelium legal in Canada? [Re: Psychonotistery]

Everyone here please let me clarify:

any substance that contains psilocybin is ILLEGAL on both federal and provincial levels in Canada. Schedule 3 classification.

This includes mycelium. @StayTrippy420, no offense but just because a site has a disclaimer does not constitute legality.

Lets also put the fresh vs dried nonsense to rest as well. They are both illegal.

You will require a Section 56 exception and only 4 people have this currently in Canada.

Subsection 56(1) of the CDSA allows the Minister of Health to exempt any person or class of persons or any controlled substance or precursor or class thereof from the application of all or any provisions of the Act or the regulations if, in the opinion of the Minister, the exemption is necessary for a medical or scientific purpose or is otherwise in the public interest.

Spores ARE legal.

Now to the reality - Enforcement

The VPD and other provincial agencies have openly stated that they will not prosecute psychedelics unless it is an immediate threat to society such as when it comes to public safety and to children.

Being uninformed and naive will get you in trouble. Use common sense and keep your grows to a personal/hobby level.

Be respectful to Law Enforcement and don't make yourself a target is my best advice to ALL.

Why should you listen to me?

I am currently working with 2 very large legal and consulting teams as well as several accredited CROs (contract research organizations) to help bring a level of legality to psilocybin use for public health benefits especially in relation to its effectiveness with mental illnesses and addictions.

Without a starting point such as a Section 56 exception, the study of the efficacy and safety of psilocybin will be stifled. Just as it was with cannabis for decades (until now). Look at CBD.

I believe psilocybin will HELP people not HARM people. That is my official stance on this and am willing to take this to the next level with my Team.

This may take a long time, but worth it. I know many people that suffer from mental disorders and addictions and i would like to see a viable and natural solution to help them with these afflictions.

I have a lot more to say on this, but this is all for now...
