In regards to Lophophora Jourdaniana

I have only seen this merely touched upon in the past, so I have to ask, would

this plant be legal to own in the US? I think its kind of a touchy subject

since it is rumored to be a variant of williamsi, but this has yet to be

proven?


I know of vendors who ship plants and seeds here?

What do you guys think?

Personally I feel that although they say diffusa is legal in the unitied states. If the wrong people where to find out about someone owning a jourdaniana and they wanted to get that person they would still get charged as though it was a williamsii. I don't think there is anyway for you to definitively prove it was diffusa , jourdaniana, Koehresii, fricii etc although they look slightly different they would test for the presence of mescaline and if there was any amount that came up positive you'd be in trouble.

Isnt the Williamsii "illegal in the US" more of a advice, or a law never cared so much about?
I have never heard about anyone getting in trouble for owning a L.Williamsii.

Anyone know someone who got in trouble for this?
Isnt it like poppies, you can grow them, but if you try extract something then you can get into trouble?

I mean I imagine you would be ok. But if police ever came into your house and you had a bunch of jourdaniana , diffusa etc. you would wind up with a charge and your picture in the newspaper like this poor fella

Again it's unlikely you would get in trouble growing poppies. But you can be charged even if you haven't harvested or scored the pods. Growing papaver somniferum is illegal in the U.S. http://myfox8.com/2017/05/23/nc-deputies-find-500-million-worth-of-opium-poppy-plants/

You're probably right. I mean to most people peyote is just peyote and if it did have any trace of mescaline in it, it would probably be legally defined as such. Meh.

Lmao, goes to show how little clue law enforcement has about our sacred plants.

I recently had a little visit from the coppers (not for me, they were looking for someone that lives across the street.

They literally parked right in front of the veranda window where all my lophs, trichos, salvias and a lot more are spending their winter and they didn't even give it a second look :smile:

There was a member of another cactus focused forum who caught a serious charge for attempting to import L. williamsii 10-15 years ago. His life was forever altered for that charge.

I can think of a few other cases that involved just posession that have occured in the past 5 years that I have really paid attention.

L. williamsii is illegal in almost every state and on the Federal level here. Usually L. williamsii charges stem from incidental finds during raids for other things like marijuana or some other drug offense like the story linked by the other poster.

I would strongly suggest that people avoid importing L. williamsii across borders as border inspections are real an frequent, importing cactus is illegal anyway, and importing a controlled substance (remember peyote is specifically scheduled) is a very serious offense.
