Executed Arkansas inmates’ attorneys call for investigation of “botched” lethal injections

Arkansas concluded its 10-day execution spree Thursday night with the killing of inmate Kenneth Williams, but the state’s legal battles show no signs of ending. Attorneys for death row prisoners in the state called Friday for an independent investigation into the four lethal injections conducted over the past week-and-a-half.

“State officials must not be allowed to cover up what went wrong in all four of these executions,” Scott Braden, of the Arkansas Federal Defender’s Office, said in a statement.

Attorneys from Braden’s office said they filed an emergency motion Friday, asking a federal court to immediately preserve evidence from Kenneth Williams’ body. Media witnesses reported seeing Williams “manifesting signs of vigorous consciousness such as lurching, jerking, convulsing, and coughing during the course of the execution,” long after the controversial sedative midazolam should have taken effect, according to the motion.

The Associated Press reported that Williams lurched forward 20 times in 20 seconds minutes after the sedative was administered.

This means, lawyers say, that Williams potentially remained conscious throughout his execution. Midazolam is meant to render the inmate unconscious before a second drug, vercuronium bromide, paralyzes him. At that point, he would be unable to move or let executioners know if the midazolam hadn’t taken full effect. The administration of the final drug, potassium chloride — it ultimately induces cardiac arrest — would then be excruciating.

“If the midazolam fails to keep the prisoner under anesthesia, the prisoner would be awake and aware but unable to move or speak or even open his eyes, so he would then look completely serene despite being in agony,” Braden said, adding that forcing Williams to experience such pain without a sedative would be a violation of the Eighth Amendment, which outlaws cruel and unusual punishment.

During the recent executions of Dennis McGuire in Ohio, Clayton Lockett in Oklahoma, Joseph Wood in Arizona, and Ronald Smith in Alabama, the inmates regained some level of consciousness due to midazolam’s failure to work properly.

Questions about whether midazolam was appropriate to use dominated legal challenges leading up to the Arkansas executions, and attorneys said their fears may have come true during the Monday double execution of inmates Jack Jones and Marcel Williams. Jones’ attorney alleges that minutes after Jones was injected with midazolam, he “was moving his lips and gulping for air. Mr. Jones’ movements after the midazolam was administered is evidence of continued consciousness.”

One of Marcel Williams’ attorneys, who was present for his client’s execution, said that Williams was moving his eyes three minutes before the time of death. She also wasn’t sure that executioners checked to make sure he was unconscious after the midazolam was administered.

Arkansas cut the sound from the execution chamber to the room in which witnesses watched after Marcel Williams declined to make a final statement — many states have similar protocols — making it more difficult for the witnesses to understand what was happening during the man’s death, Death Penalty Information Center Executive Director Robert Dunham told VICE News Thursday.

“Everybody agreed that he was moving his lips, and without the sound you don’t whether he’s gurgling, you don’t know whether he’s gasping, you don’t know what it is,” Dunham said. “With their affirmatively making unavailable any of the audio evidence, that has left it impossible to determine what happened.”

Arkansas Gov. Asa Hutchinson (pictured above) said in a Friday press conference that all of the executions went according to plan. “I see no reason for any investigation other than the routine review that is done after every execution,” he said.

I don't think the death penalty is a reasonable deterrent for the crimes it's used to punish.  Depending on the prisoner, the state, and the prison itself, it's not always "more expensive" to execute them--just look recently at Charles Manson.
But I'm not outraged.  I think if execution is in order, trying to mix up a lethal cocktail of drugs to inject is retarded when a bullet to the brain doesn't even require a doctor to administer.  Hell it could be done by a machine.  One of those air guns they use on cattle.  Bam, easy and cheap.  But I don't think it helps anything to do so.  I can imagine that death is welcomed by most after spending so much time on death row which probably fucking sucks way worse than a painless death.

A firing squad is so fucked up though.  The people on the firing line can get all traumatized and PTSD'd from it.
I say just one of the air guns they use on cattle right to the dome in an automated machine.  It's over quick and painless, no PTSD from firing squad peeps, no drug cocktail infusion disasters where the person doesn't die like they're supposed to, etc.

I rather the firing squad if I could pick.

I feel the only way those who take part in execution should be required to have a hands on execution because adding all thread chemicals when those that condemned him can watch behind a glass wall.

I think death penalty reforms starts with humanizing the process by making the executioners kill them up close and personal so they can rethink their job.

I think firing squad is more humane than potassium chloride. It burns. It burns through all your veins until it stops your heart.

Well a botched execution isn't as traumatic, and thus less consequential, when the inmate is paralyzed. Firing squad... Well those guys have good reason to make sure it as quick and efficient as possible.

Plus firing squads are given one blank at random which leaves executioners room for doubt as to whether or not they killed a man.

1-  I think some of the PTSD issue comes not just from the method in question, but also the fact that they then have to live with the knowledge that they killed a man (or at least might have killed a man.)  And with your cow-gun idea, someone would still have to flip a switch, or push a button, or something. Of course, they could set up some mechanism where there are 4 switches, 4 guys, 1 switch is "activated" at random, the others do nothing, that kind of thing...


2- I think if we're going to kill people, they should at least get to choose between a few relatively humane options.


3- I think the way we use chemicals to kill people is retarded. We should be using opioids. Full stop. Barbiturates, secondary to that. Maybe a combo of the two. That would be the quickest and most painless death. As humane as you can get. But I think that's the exact problem. See, if we used an opioid, they might even experience a very brief moment or two of pleasure on their way out the door. And some people really do not want that, under any circumstances. Even if it means they die a horrific death. In fact, some other people would actively want them to suffer a horrific death! Some people are stuck in a very primal, reactive, barbaric "eye for an eye" vengeance-mentality, and don't look at this as a social problem that needs to be solved with reason, so much as a chance to make themselves feel better by playing god / the hand of karma / whatever, and passing harsh judgment on someone they've never met.


Yes, there are some real scumbags out there. Yes, if some of these people are wholly beyond hope of redemption, maybe we need better ways to remove them from society. Maybe even occasionally up to removing them from the society within the prisons as well. But I think if we, as a society, are going to pass that kind of judgment on our fellow man, and take it upon ourselves to end human lives, we should be doing that from a place of responsibility and carefully measured consideration, and should generally seek to be better than the men we would condemn to death.  Coming from a standpoint of eye-for-an-eye vengeance and wanting to inflict maximum suffering on a captive human being, merely drags us down to their base level. If we're going to kill people, we should be doing it as humanely as possible. Even if that means no suffering. Even if that means 3 seconds of ecstasy before their consciousness is erased from the earth.


If you believe in god, then let him do the judging and punishing.


If you don't believe in god... well, I guess we're all just randomly conscious meat anyway. Don't be angry / hateful meat. It's not fun for the other meat.

Exactly, except the machine is automated.  You lie down on a table and the machine does everything else automatically.  It's weight and motion activated.  A power switch is flipped on to the entire building that activates not only the machine, but the way to even enter the building.  No one has pulled a switch to kill anyone.

And what if the inmate doesn't want to get on the platform? the guards that have to force him down would be killing him. And worse, be very up close and personal when the deed is done.

I don't think that a person strapping the inmate to the table where they die, and then leaving the room and allowing it to happen through no further action on their part, and not witnessing it, would cause the people who strapped the inmate down for execution will suffer much PTSD from that.  I mean, there's already people who strap them down for the executions as they happen nowadays the only difference is there's a doctor pumping them with questionable drugs after that.

They should put all death row inmates in a room and make them play simon says elimination style and have it rigged to loser dies. That way all death is on simon and the user :shrug:

I am against the death penalty, it should never be done.

If you insist on executing people, you're doing it all wrong.

Use a vacuum chamber.

Put someone into a small chamber that is connected to a tank with a trip valve. Pump enough air out of the tank so that when the trip valve opens, at once the air pressure in both vessels drops to a point comparable to an altitude somewhat higher than the Mount Everest.

The person gets giddy, then falls unconscious and soon, expires because of insufficient oxygen. A fool proof system, it cannot be botched and there is no poison or high voltage to endanger personnel, no medicines which can be boycotted (like now with lethal injection), the death is swift, painless and is cost effective.

The vacuum chamber, a hypobaric chamber that kills by slight reduction of atmospheric pressure.

But don't kill people. Seriously. The death penalty should end.

IF you are going to use lethal injection, use a single drug, a drug that induces a certain coma before it gets certainly lethal, and yes like CidneyIdole suggests either a barbiturate or an opioid. Slam him with several lethal doses worth of Pentobarbital or Fentanyl and keep them coming until death ensues.

But seriously, no death penalty.

I want to say im with you.....BUT i just keep imagining one of those guys killing my brother or some shit....as much as I love life I know deep down I wouldnt have that kind of restraint :/
