Dismissed felony and 2nd amendment help

Okay, ive seen my backround check before. what it shows is vucsa Felony : Dismissed.

WA state

The story is, I was arrested for selling weed about 5 years ago, i was charged with a VUCSA with intent to distribute. I had a clean record before this, i remember eventually taking a plea deal for a lesser charge of attempted VUCSA wich was a gross-misdameanor instead of a class-C felony. i served just under 1 week and had to do work crew for 30 days and was on inactive probation for 2 years and also had my licence suspended even tho i never had a licence and i wasnt driving at the time or anything lol.
my case was to be dismissed upon the completion of everything i needed to do and i made sure i took care of everything and i finished it all by my next court date and have never been in trouble since then.


So im curious if this will prevent me from ever being able to legally own a gun. and im also trying to find out if i was cheated by the court system on this. I dont know why but i distinctly remember my plea deal being a gross-misdemeanor so i am confused as to why my backround check would show "felony : dismissed" on it and not misdemeanor.

This is the only thing on my record and i have to pay extra fee's while trying to get my licence and ive failed backround checks for jobs before because of this.

is it possible they have made a mistake or something? i was very puzzled by having to pay extra fines while getting my driving permit and it was because of this charge i got because thats the only thing thats ever happened to me so it has to be that.(they wouldnt tell me why at the dmv)

Just look for some sort of feedback/support because im feeling pretty down about it right now lol. I feel like this isnt right to have to deal with this i was trying to explain what happened and stuff but it seems like the dmv doesnt care, what woulda been my employer didnt care.

Felony dismissed just means you were charged with a felony initially but you were convicted for a lesser charge.  I personally think it is bullshit for it to be on your record at all as a felony since it was dismissed, but it is what it is.  Technically it should not prevent you from getting a pistol permit, but the jerk doing the background check might find it as cause for denial.  So get an attorney to represent you in case you need to appeal the denial of your permit.

Move somewhere where it's illegal to check your arrest record for employment.

just go and try and buy a gun, fill out the paperwork, and see what comes back.

Typically you dont even have to put anything down on the gun, or if you do, its fully refundable if you dont pass the check.

but i will say, regardless of what you dont remember about your plea deal... that is a deal, that you signed, and you are bound by the terms of it weather you like it or not.

well i actually do remember my attoney for the case telling me i was taking a gross misdemeanor instead of taking a felony thats the only reason why i took the deal and im sure i could find the paper work on it. i was just mostly curious for my own benifit what you guys thought. your input has been very encouraging for me tho.

and yeah i wasnt even sure what could happen if i tried to buy a gun or something like that, im sure every state has different guidelines but im not even sure if guns are state-handled or strictly federal. just to talk to an attourny to ask questions usually cost around $40 or $50 dollars so i figured i would see what u guys had to say about it before i payed any money to talk to someone to get things straightened out.

zymosis, so a felony : dismissed on my record would mean that i prolyl did take a deal for a lesser charge, i.e. gross misdemeanor and it would be normal for it to still say felony dismissed? or is there a possibility that might have screwed up and forgot to change it to gross misdemeanor? if this is the case i know i have kept all my documents somewhere i would just need to find them, because they would be bound to uphold the deal just as i am bound to it right? also it was dismissed with prejudice, im not sure what the difference is other then i know they cannot reopen the case against me. would that be a problem if they made a mistake on my record and cant reopen the case to fix it? provided i have the paperwork from my plea deal to prove that they did in fact make a mistake

well if you're a felon, you have the responsibility of knowing that. if you're a felon, you cant have a gun.

if because of some legal issue, you dont know if you're a felon, call your attorney. if you were too broke to afford an attorney for your charge, call the court, and ask what the status of your case is. knowing if you're a convicted felon is pretty important in regard to your life moving forward.

i know that certain states, if you try and buy a gun, will send the cops right to the store where you are at. typically that is done if you have an active warrant. hell, half of the gun shops have a scanner next to the phone, they know if someone is coming for you.

but in a scenario like yours... its not like you're a wanted man. there might be a reason for a denial on your record. and if thats the case, more often than not, theyll give you information to follow up on.

then again, if you're a felon who is specifically banned from owning a gun, who is trying to buy a gun, they'll take your ass to prison, rightfully so.

and honestly, if you dont have the mental ability to know what the status of your case is, and the plea bargain you signed, you dont have any business owning a firearm.

i know the plea bargin i signed, dont insult me lol. i signed a plea bargin for a gross-misdeamnor and completed everything to have my case dismissed. i dont plan to even carry, just have a means to defend my home in case of armed burgulary or something of that nature. i damn sure wont depend on the police to keep me safe.

my concern comes from me knowing that i took a plea deal for a gross misdemeanor but yet ive failed a backround check at a job before, they eventually got it straightened out and woulda hired me then but the time it took to clear everything my position was filled.

i am also getting extra fee's racked on at the dmv while getting my driving permit. and they told me i will get more fees again while getting my licence. the reason i am having these problems is becuase i did ask my attorny all tehse questions years ago while i was finishing up my trial. he told me it would never effect me, wich apparently was a lie to my face. before going through the court system i was not informed of my rights, i did not know what to expect and i never had delt with court systems before.

this is where my confusion comes from, not because i dont know what i signed becuase i do. what i signed doesnt add up to what i have on my record and what my attournt told me back then. he also withdrew from my case near the very end also but i was already done with everything anyways. he now doesnt work here and moved to pheonix AZ.

thx for the input tho and sorry if i took what u said out of context. but i dont think a teen clueless about the court system being taken advantage of over a bullshit charge that the govn that convicted me now partakes in somehow would give you any reason to tell me you dont think i should own a firearm. that sounds very system like of you
