Under International and US Law, many Syrian Refugees DO Not Qualify for Asylum in the US

People here seem to think the mere presence of existence in a war zone qualifies one for asylum.  It doesn't.  From Wiki:

"The United States is obliged to recognize valid claims for asylum under the 1951 Convention Relating to the Status of Refugees and its 1967 Protocol."

US Asylum law is based on this protocol.

Requirements:

1: 'an asylum applicant must establish that he or she fears persecution.'

2: ' the applicant must prove that he or she would be persecuted on account of one of five protected grounds: race, religion, nationality, political opinion, and social group.'

3: 'Third, an applicant must establish that the government is either involved in the persecution, or unable to control the conduct of private actors.'

That is a fairly strict criteria of what is required.

I state this because many people seem to believe Emotion and Feelings are what qualify one for asylum.  Just because someone gives a speech and gets people worked up emotionally is not a valid reason.  And I highlight 'Religion' because it is a key factor in many cases.  Sorry, it looks like Ted Cruz is right.  Again.

It sounds to me like Syrians meet criteria 1, 2, AND 3.

yeah syrians def meet those requirements.

esp considering there is two regimes in the area that would persecute them on any number of the listed grounds (or taking #3 more into account, currently one state actor and one private actor)

Who fucking cares if they meet the criteria? The Boston bombers were refugees too, remember how well that worked out?

That aside, let the rich Arab nations take them, it's much closer and much cheaper, they will less hardship acclimating to a Muslim culture...

But then, we don't get more terrorists here, so maybe we should take them, go Obama!

yeh.. well the US denied 1000s of jewish children refugees.. look how that turned out.

refugees are refugees, the US checks are some of the most, if not the most, stringent in the world. hostile universe is just an islamophobe.

there is a ceiling admission rate of 80,000 a year and this includes ALL countries where the rules apply to. they include countries with not just muslims. Only since 2013 has that quota has started to be met. 70,000 in 2013. 85,000 in 2016.. but as i say - thats from all countries and i belive the quota for syrians in 2016 is around 10,000 Syrian refugees referred to the US from UNHRC.

youre right on this point, hostile, so would you agree the US military should maybe cut down a bit? It could cut down by half and still spend more than any other country by far. Then we can deal with the shitty labor market you speak of, poverty, and the massive neglect of this country's veterans.

its right that states can't reject refugees, once they have been vetted it is safe, it is against US law to discriminate against them. rightly so.

SD is thankful she doesnt live in Europe, though i wonder if she has known anything about Europe without it being from Hannity,

but it is a fact that refugees going to the US are more checked than any other country. Syrian refugees coming to the US go via American nonprofits after referred from the UNHRC from refugee camps. In Europe, this happens but also people are trying to come anyway and just cross the border. When i say JUST cross the border, thousands of men women and children die on the way. Yes this method is significantly open to risk. The Paris attacks were carried out not by refugees but by Belgian and French nationals but checks in Europe still need to be strong.

But i hope everyone would agree with this situation wouldnt happen in the first place if the US didn't go for an illegal war killing at least 500,000 civilians in Iraq, not to mention the thousands dead in Afghanistan. And Afghanistan and Iraq are more screwed up now then before the invasion. Also..if the US is so close to Saudi Arabia - who behead people on a huge scale for things like denouncing Islam or protesting, then when are we the largest supplier of weaponry to Saudi Arabia? Just for oil? at the expense of a stronger Daesh? Why would Islamic extremists want to attack America in the first place? what have they ever done to them??!
BUT its done now, all we can do now is try to reduce radicalisation (on all sides - including on the US side), do thorough security checks and to fulfil basic humanitarian duties.

You think the only problem the refugees bring in is terrorism?  Minus the terrorism these refugees are a huge social and financial burden for the countries bring them in, that's a good enough reason to stop the flow.

i think you are grasping at straws. but please elaborate what you mean when you say huge social and financial burden.

yes of course there are costs involved but these people are fleeing for their lives and they will recover and contribute. Most refugee resettlment programmes involve the condition that they find a job and pay back their plane ticket etc. as well as contributing to taxes anyway.
these people dont just come to milk the social security system, they have to work and have the motivation to work.
ultimately, it is also the morally right thing to do.

the only hatred and racism i see is coming from you, mate. Can you elaborate? Many syrian muslims look towards the US for hope and would be grateful receiving such kindness and support, in order to contribute back. If you treat them like shit, then yeh maybe they would get a little alienated. They have lived through shit that you could not imagine and all they want is to not be killed or live in fear.

I can tell you that all that stuff about "no go areas" is complete propaganda and crap propaganda at that. I also heard on Fox that Birmingham is a self-declared Muslim-only city and a no go area for "others". This is just not true.. at all. there is no truth to this. I know many people in Birmingham, I have been to Birmingham and even if i hadn't, i would know that this is hate-stirring and ignorance.

source - I am also British and live there more than half of the year. I also live in France and can tell you this is just not true. Have you even been there?

the majority of refugees are children, some orphaned. If they get a chance to get back on their feet, as is a reasonable moral thing to do after what they have been through, they can contribute to America. As i said before, yes at first there would be costs in supporting them but i suspect this - in part comes from the nonprofits, donations and the government. Even if it was solely the government, they need a chance to come back. A condition on their resettlement is that they get jobs.

i ask you to come back with statistics to show how extensive you say it is all these costs. yes, the ones coming via UNHRC refugee camps are poor. But, they are fleeing death. Give them a break!

Also.. war makes many people poor, when you have your business bombed, your family killed, when massive food poverty hits and prices go up for food and water.. so yes people end up poor. the war has gone on for quite a while now! BUT before the war, Syrian people were productive people who contributed to their society. And they can again, given the chance. In the UK, immigrants (so not even including refugees) give more in taxes than they take but the Murdoch media still want all of us to hate them for being parasites..

America also denied entry of Jewish refugees (many children) and sent them back to Germany during the war. Many ended up in concentration camps and were slaughtered.

I think your confusing their best of intention and then the reality of the situation.

The EU and US has tens of millions of citizens that are working eligible and do NOT have jobs, the majority of them would love to work and contribute to the economy, but the reality on the ground is that it's not possible.

What makes you think people from a foreign land with a lack of skills, education, language, and money can contribute to a economy when tens of millions of natives can't do it when they have already been living there for decades?

This isn't about racism and bigotry, this is about economics, the EU and US already have a massive surplus of labor, the US and EU already has too many people living in poverty, both have debt to GDP's of over 100%, these countries can't afford them and the refugee can NEVER pay it back even if they wanted.
