and was curious what the pubs thoughts on it were
also-how would one be able to better safe-guard themselves from information retrieval?

BitTorrent study finds most file-sharers are monitored


Anyone using file-sharing service BitTorrent to download the latest film or music release is likely to be monitored, UK-based researchers suggest.

A Birmingham University study indicates that an illegal file-sharer downloading popular content would be logged by a monitoring firm within three hours.

The team said it was "surprised" by the scale of the monitoring.

Copyright holders could use the data to crack down on illegal downloads.

The three-year research was carried out by a team of computer scientists who developed software that acted like a BitTorrent file-sharing client and logged all the connections made to it.

BitTorrent is a method of obtaining files by downloading from many users at the same time.

The logs revealed that monitoring did not distinguish between hardcore illegal downloaders and those new to it.

"You don't have to be a mass downloader. Someone who downloads a single movie will be logged as well," said Dr Tom Chothia, who led the research.

"If the content was in the top 100 it was monitored within hours," he said. "Someone will notice and it will be recorded."

Less popular content was also monitored although less frequently, the study indicated.
Marketing tool

The research identified about 10 different monitoring firms logging content. Of these, a handful were identifiable as copyright-enforcement organisations, security firms and even other research labs.

But about six of the biggest-scale monitors were harder to identify, as the companies behind them used third-party hosting firms to run the searches for them.

Why such firms wanted the massive amounts of data was unclear, said Dr Chothia.

"Many firms are simply sitting on the data. Such monitoring is easy to do and the data is out there so they think they may as well collect it as it may be valuable in future," he said.

Some firms alleged to be carrying out mass-scale monitoring have been accused of selling the data to copyright holders for marketing purposes.

"The data shows what content is popular and where," said Dr Chothia.

The study also revealed that so-called blocklists, used by some illegal file-sharers to prevent monitors from connecting to their computers, might not be much use.

"Many of the monitors we found weren't on the blocklists so these measures to bypass the monitors aren't really working," said Dr Chothia.
Hard evidence

Some copyright owners in Europe and the US are using IP addresses gathered by monitoring firms to apply for court orders obliging internet service providers to hand over the physical addresses associated with them.

They are then writing to individuals seeking recompense or warning of the possibility of court action.

But Dr Chothia doubts evidence gathered in this manner would stand up in court.

"All the monitors observed during the study would connect to file-sharers and verify that they were running the BitTorrent software, but they would not actually collect any of the files being shared," he said.

"It is questionable whether the monitors observed would actually have evidence of file-sharing that would stand up in court," he added.

Lawyers have previously cast doubt on whether evidence collected from an IP address can be used in court because such an address pinpoints the internet connection used for downloading rather than a specific individual.

I don't agree with people downloading copyright files for free that people and companies worked hard to create.  If I worked hard and created something (like a music album) and it was copyright, I would want people to spend money to get my product so that I am not working hard just to give my product away for free.  People need money to survive in this world, and creating a product that people want should mean getting the money for the product that is deserved so people can survive and make a living for themselves.

That is why I will never download copyright files :thumbdown:

Before I was even done reading this is exactly what I was gonna say. It doesn't really bother me because it doesn't sound like its good monitoring technique. Also it said at one point the reason for the monitoring is "unclear," which is a good word for it.

Why do this if its essentially useless information? I mean what are you gonna do, start arresting people on the list Gestapo style?

W/e, I torrent so infrequently it doesn't really bother me. Maybe three or four things a year.

Well one way to protect yourself from being monitored would be using a good VPN.

Or just not using torrents.

They're probably keeping logs to get an idea of their market share vs. piracy.  If they didn't monitor piracy, they couldn't factor that (potential) lost revenue in moving forward with financing and production, and likewise, have a difficult time planning financially as a company.
It's also possible they plan to use the aggregate data as a means to gain favorable anti-piracy legislation by way of showing lost revenue (and thus, tax dollars) to the government in the future.
However, with the exception of the largest pirates out there, I doubt the companies are using it as evidence for building a case.  As was mentioned, it probably wouldn't be admissible in court considering the means by which the data was gathered in the first place.

On that same token, pirates will never go away, so the artists and companies need to figure out a way to change with the times and evolve with the pirates or they are just shooting themselves in the foot. Many artists are going off on their own now and making and promoting their own albums, giving it away for free and letting people download it for free. And profiting more than ever because no greedy middle man. Fuck the record companies we don't need you. People still make their money even with pirates existing you just have to figure out how to be smart, and not follow an archaic failing business model.

This is what the media industry struggles so hard with, when everyone wants everything instant and streaming ala netflix. But the movie companies don't want it. Fucking stupid dinosaurs.

It's not about pirating. It's about the plan fucking sucks. People WOULD and do pay for stuff if it was instant and streaming and high quality. MANY people pirate and torrent simply because something may be harder to find otherwise. Also many people pirate something to test it out first. If it's really good and they want to support it, they will go out and buy it.

If their plan was good you could download all music and movies ever in existence  from a central database for a monthly fee and they would make trillions,
But instead they are suing 14 year old kids for 200,000 per song

In the end pirating is a good thing for everyone and the RIAA can suck my balls.

It's kind of like the War on Drugs.
Pirates will never fucking go away. Ever.
Adapt and evolve or fight an endless one-sided war you will never, ever win.

Radiohead started the whole "free internet album download" thing with their albums.  If I was making music, unless I was already really successful and rich, I wouldn't release my albums for free but I would probably have 1 or 2 songs that you could download for free to motivate people to buy the whole album or to let people who don't have money have some of my music. 

The thing is, I personally probably won't ever make "products" like music albums or movies to try to make a living off of, so I probably won't ever have to worry about people getting my product for free, or having to find a way to market my product so that people can't download it for free.  Those in the music and movie business (as well as those companies who make expensive programs such as Adobe) are, like you said, going to have to get with the times and make it so that people can't download their products for free if they care about profits.

Saul Williams did that too, with his last album produced by Trent Reznor. Available for free but donate if you like it. He did pretty well. Lots of artists are trying to go that way I think.

Art shouldn't be bound by an artist's greed.  They're making art for the wrong reasons if that is the case.  My support comes in the form of being a fan and spreading the word of their art; it doesn't come in the form of money.  Fuck that.  Anyone one retarded enough to try and make money in the music business these days is, well, retarded.

Who are you to say what reasons somebody should make art? If they happen to be good at it and want to use it to make a living, why shouldn't they? You want them to make art while simultaneously working some shitty 9-5? Who are you to impose that life on them

They can try all they want to make money, doesn't mean I'm paying a dime if I can download it.  Our society thinks that money makes everything better.  Everyone has their fucking hands out.  I don't care if they work a shitty 9-5 or not.  Art is a means of self-expression, and it'll flourish whether money's involved or not.  Not everyone needs a payday from their art.

Those examples would deprive the service provider from paying customers as you'd occupy a place with your presence.

Making a copy of a film uses other torrenters upload bandwidth, something that was otherwise going to waste.

I only buy CD's. DVD's have stupid unskippable antipiracy adverts that treats everyone like criminal scum. So they can get tae fuck. CD's are great. No DRM, good enough sound quality (there's that stupid 44.1khz sampling thing so a CD is not as good as a 48khz master tape) and I can copy it into any format I want and play it on any device I want.

As long as money rules whether people can have good qualities of life or not (and I don't see it changing any time soon) then when I work I want to be paid, just like everybody else.  If you are an artist and work a 9 -5 job, that gives you 8 hours less of time per day to be able to work on your art.  If you want to make high-quality art, then it's going to require more than just 4 hours per day from the time you get off work and have dinner to the time you go to sleep so that you are well-rested for work the next day.  There's nothing wrong with devoting your entire day to doing your art and trying to make it big and get paid for it.  There's nothing appealing about being a starving artist.
