The only reason tomatoes are considered vegetables legally is so that they could impose more tariffs on them way back when.  And the only reason they're considered that way culinarily is because since the government classifies it as a veggie, that's how it's always been labeled.

no i think he means in a culinary sense, you use tomato like a vegetable, not a fruit. You don't garnish sandwhich's with fruit, you use vegetables. From anything.. pasta's, sandwhich's, soups etc. Tomato is used as a vegetable

If it has seeds it's a fruit.  Vegetables don't have seeds.

What you learn in biology is great, but every field has its own jargon.  I think its good to use the jargon relative to the field to prevent communication breakdowns and the like.  In medicine they have a different meaning of 'plasma' than they do in physics.  Ignore that at your own peril!
