psilocybe mycelium question

this is my first time posting to this list. and i'm sure this should be asked under the legal section. but i'm in need of a quick answer. PLEASE HELP!!!!
to make a long story short. the cops raided my place after a tip they recieved from a maintenance guy that robbed my apt. he took my bud, a grip of cash and saw what he wasn't suppose to see.
when the bastard cops came in, they found jars of mycelium growing, hidden away, out of sight. no mushrooms where siezed, since this was only an experiment to grow the mycelium. my question is; is psilocybe mycelium, that is not 100% colonized, illegal to have?

no charges have been brought up on me yet. but they want me of course to come in to talk. i have a good lawyer, but he has no experience with this kynd of case.
any help is much appreciated. and i have Richard Glen Boires' book on the way.
