I did have to expandable batons in the car. One was in the driver's side map pocket, one was stuck down between the driver's seat and center console. Only one or two inches of the butt was visible. That would not have been probable cause. It could have been the butt of a flash light.

I just got fucked over that night. They didn't like being schooled by a teenager who knew his rights and were just out to fuck someone's night up.

i have heard if you win the lawsuit the person your suing pays the court costs and attorney fees, maybe it's false though.

Wow, wild story.  I'm so sorry this happened to you.  I can not wait until your lawyer gets the video and shows it to the court and gets this dismissed.  Because that's what's going to happen.  They didn't have consent or probable cause to search your car and they did it anyway.  Keep us updated!

This is true but not always. The loser of the case doesn't always get awarded costs. Only if they are innocent and have done no wrong. I.e. : civil claim where i say you broke my fence and i had to pay for it. If i won and you were completely wrong, i would get compensation + costs.

BUT, if i still won, but helped to break the fenc, or neglected it on purpose, so that it would need replacing, then the judge might award compensation but make each party pay only their own costs, because i was somewhat at fault also.

When you say you "held your ground" - does this mean that you flat-out said "no," or did you give him some ridiculous ambiguous answer like, "none of your business"?

A cop's business is everything that's none of his business, and I believe this argument holds water in a court of law - the lack of a straight "no" answer means probable cause, and a warrant-free search.

Always remember, kids - deny everything. :hst:

I've only been asked to search my car once.  I was speeding in 2002.  While he was writing up my ticket I was coming up with my excuse.  I had JUST read about my rights on The Shroomery and knew what to do.  When he asked to search my car, I told him no because I was in a hurry.  This was a plausible excuse because I was speeding.  He even asked me where I was going and I was ready for it.  I told him I was meeting my parents.  Then I changed the subject on him and it was over.  I had drugs in the car too.  But I'd deny a search even if I hadn't, just on principle.

I was like, "No, officer, you cannot search my vehicle". He replied, "Why not? Do you have something to hide?". I answered, "No sir, I have just drove fourteen hours back from New York, I'm very tired and sleepy, and need to be headed home".

Did you put the bowl under your seat while you were being pulled over?  Did the Officer see you act weird while in the act of being pulled over. Like fumbling around the front seat or leaning over to stash the pipe?  If he saw you moving around, that would make him very suspicious. It would make him think, A)Is he going for his weapon?  Or B) is he attempting to conceal something?

If you were sick and had the chills that would also make him think maybe you were nervous instead, possibly.

yeah, whenever i'm being followed by police officers, i make sure i don't move ym head when i check my mirrors, because they will see you looking up and back constantly, and if im going to hide anything i make sure i move very slowly and only in such a way that my shoulders wont move, and they wont be able to see me moving or hiding things.

The worst thing you can do is dart around spontaneously and draw attention to yourself, because this will make them think your up to something.

But i mean, if you are a clean looking person, with no record, and im speaking on experiences in Australia, 9/10 if you get pulled over they will never ask to search your car. Even if you have shit on you, if it's not clearly visible, isn't stinking up the car, just put on the poker face and act like a normal person. It's all you can really do when you think about it. If you freak out, or respond in a strange way your only going to draw unwanted attention to yourself. I just talk and be like hey hows it going, rah rah rah, talk normally, smile, make eye contact, and they think your an honest citizen with nothing to hide.

I am very conscious of everything you mentioned. When reaching for my lock box, I have gorilla arms, so I was able to do it with minimal head movement as well as when stashing my pipe under the seat. They had NO excuse to be inside my vehicle. They just wanted to fuck my night up after I gave them a hard time.

I am also very conscious of eye contact, touching my hands, touching my hair and face. I give NO signals of nervousness or deceit. I've got my game on around cops.

Sounds like you did everything right.  You had a good story and were conscious of your movements, etc.  I think you'll beat this thing.  These cops have just probably never been in a situation where someone has questioned the search, which is why they thought nothing of searching you illegally.  They might not suspect that your lawyer will ask for the tape.  It might be all new to them. 

Does anyone think he'll be able to sue for his attorney fees, etc?  I saw someone mention it, but no one answered.

Well, like I said, when the cop ran past me and yelled "Well I DO get to search for weapons!", I believe I may had said "ok", hoping he would find the batons and call the search off. That would be consent to a search I'm pretty sure, even though I had previously denied consent. In that case, getting the tape would be a bad idea, because now even if I say I denied and was searched illegally, they would have proof if I did say "ok" at the time. Either way it will all blow over. Being alive is still awesome with its ups and downs.

How loud did you say it and how was it said?  Claim that you said "OK" in kind of a flippant or sarcastic manner AFTER it was obvious that he was already going ahead with his illegal search.

I glanced at just the right time to catch her first and last name entered in. I came home, found her on Facebook, and added her. We will see where this goes. She was so fucking cool. :awesome:


I've got updates, guys! We have been talking back and forth on Facebook. Oddly enough, I'm off this coming Friday and the following Wednesday and Thursday, and she has the EXACT same days off. Oh yeah!

Since I'm always asking for people to post pictures of the girl they are talking with at the moment, I figure I should do that myself. She has a nice body. I could use a little more meat on the bones, but at least she isn't overweight. She is cute though. The pictures don't really do her justice. They make her pale looking. I don't think she ever wears make up either. As far as her personality, she is very cool. She is a corrections officer, but she wants to try psychedelics. She plans on going to college for archeology this summer, so she won't be on the "other side" forever. :thumbup:

I got pulled over for having my front liscence on my dash and fucked with by Williamson county police in Liberty Hill a couple days ago. I informed my friend to lock the door and roll up the window if asked to exit the vehicle. He asked me to exit and I did the same. The cop immediately noticed me doing this and asked me why I did it. I camly and respectfully explained that I had my doubts harbored in the county police forces due to their numerous exploits. (Seriously the worst county in Texas) He didnt call my bluff and after a easy and predictable interrogation he let us go with a warning. Had a pipe in my friends disc golf bag. But its a citation here.

Ya that's crazy you got arrested for just a pipe...
Here in WA if the cop wasn't a dick they might just let you go...or it's like $100 fine.

anyone else think it's possible they think you're higher up than you are, and she's trying to infiltrate?  Call me crazy :shrug: I just don't trust cops that say they wanna trip after you've been arrested by their station
