they are no longer exempt. they were accused and found guilty of ‘assisting in making copyright content available’. if they were found guilty that is now case law. it set a precedent.

the reason they are selling is because they cannot afford to pay the damages ($905,000 each) and the site was ordered offline. they are still up though, in the last hurah of being pirates.
