a copyright question

I was wondering if it would be legal to use an image from google images, and completely reconstruct it using only lines (Adobe Illustrator), make some minor changes and then submit it as a t-shirt design.

I would be working from an old photo of a native american chief - not a design someone else has already created.

(C)ould I do this?

It is not. Traced images are not original work.

That being said, a lot of people do that.

whose to say you didn't draw it in the first place

i doubt anybody's going to go on fucking google images and type in "native american chiefs" to see if your work is original

If it becomes popular, somebody will put two and two together.  There was a "hand drawn" poster of Obama during the campaign that was used extensively.  Some photographer claimed that the "hand drawn" poster was actually a trace of a real picture that he took (and copyrighted).  You could hold them up side by side and they were basically identical.  Donno what happened, but the point is somebody noticed.

I do plan on modifying it to a degree. My idea is to have him smoking a peace pipe or something. not sure yet, I'll develop the idea as I get deeper into it.

And just fyi, that's no ordinary chief, thats the late great sitting bull.

A famous case is that of the seminal image of che guevara

You might want to check out the proceedings on that case. There was some to do about that a couple of years ago.
