so technicaly, if you ever ended up in court with it against you and theres evidence that your a drug user of some sort, im sure they could use it against you wether or not you say its incense. there is plenty of attention growing towards these plants.

If you are talking about Trichocereus Pachanoi and live in the
USA. They are perfectly legal.
You can buy them just about anywhere.
The only cactus made illegal by the DEA is
the Lophophora williamsii (Peyote).
All the other Lophpho's are legal (like the L. Diffusa)
