Police say they gave her a hallucinogen

Two Conejo Valley teen-agers were charged Friday in the drug-related death of a 17-year-old Newbury Park girl who was struck and killed while walking naked last month on Highway 101.
Brian Mit-chell and Alissa Ruef, both 18, are charged with giving drugs to a minor, and Mitchell also is accused of involuntary manslaughter in the death of Victoria "Tia" Nugent.
Both pleaded not guilty in Ventura County Superior Court and are being held in Ventura County Jail with bail set at $55,000 each.
A preliminary hearing was set for Sept. 17.
Nugent, a recent graduate of Newbury Park High School, was killed Aug. 15 while walking nude on Highway 101 near Wendy Drive about 3 a.m, police said.
Prosecutors allege she was under the influence of psychedelic mushrooms when she walked onto the highway. The Van Nuys man whose vehicle struck Nugent was not cited.
Although toxicology results are not yet available, Deputy District Attorney Ryan Wright said Friday he has substantial evidence Nugent was under the influence of the mind-altering drug.
Psychedelic mushrooms contain the chemical psilocybin, which can cause hallucinations after ingestion, according to the National Drug Intelligence Center Web site. A person could also lose the ability to distinguish fantasy from reality while on the drug.
"A lot of teenagers say, 'It's just mushrooms,' " Wright said. "Unfortunately for Miss Nugent, her reaction to those mushrooms was not good."
Accused of supplying drugs
Mitchell and Ruef are charged with supplying Nugent with the mushrooms the night she died. Mitchell's manslaughter charge alleges he contributed to her death.
"Furnishing drugs to a minor is an extremely serious case," Wright said, adding that he has sufficient evidence to hold Mitchell responsible for Nugent's death.
Nugent's friends expressed mixed feelings about the charges. Many of them knew Ruef from school but did not know Mitchell.
Casey Fleher, 18, said he is glad to see someone being held responsible, but said Ruef's case might be unfair.
"I really don't think Alissa is being prosecuted for the right reasons," he said. "She was one of Tia's good friends."
'You can't even mess with drugs'
Fleher said drugs are a problem in Ventura County, but especially in Newbury Park because of its small-town feel. Nugent's death, however, sent a clear message.
"People have learned from this," he said. "Her really close friends have learned from this. You can't do drugs. You can't even mess with drugs."
Nugent's friend Jen Flanagan, 18, said she is unsure whether prosecuting Mitchell and Ruef is the right thing to do.
"It is partially their fault, but then, I don't know," Flanagan said. "Because they did supply it for her. But they weren't looking out for her. But I'm not quite sure how I feel about it yet."
Flanagan said she has heard Nugent had taken psychedelic mushrooms, but without toxicology results to prove which drug was in Nugent's system, Flanagan remains skeptical.
"It could have been so many things," she said.
Details sketchy
Details of what happened before Nugent died are sketchy and remain under investigation by the Ventura County Sheriff's Department.
"The whole thing is still kind of awkward because we weren't there," Flanagan said. "The only person who really knows the whole story is Tia."
But Flanagan said she doesn't doubt Nugent was on drugs when she died.
"That was not Tia. That was not her. That was not something she would ever have done," Flanagan said. "That was the only way that something like this would have happened. It wasn't even like Tia to be by herself. This is a girl who loved to have people around her all the time. That aspect of it is really weird."
Nearly 400 of Nugent's family and friends attended her memorial service in Thousand Oaks last month. She was buried in St. Louis, where she grew up. None of her family and friends attended Friday's arraignment.
"Something good has to come out of it," said Sue Shields, whose son Cody was Nugent's friend. "Somebody has to learn a lesson.
"Now there's another 18-year-old kid," she said, referring to Ruef. "It's really sad."
"There's going to be no winners in any of this," Wright said, speaking not only about Nugent's relatives, but Ruef's and Mitchell's. "Their kids are going to be taken away from them for some time. But at least they get to go home someday."

Wow, thats pretty sad. What I don't understand though is how you don't see a naked girl in the middle of the road? Sounds a little fishy to me, I think the wrong people are being held responsible.

it's so rediculous that people get charged because someone else did something stupid, I've taken tons of mushrooms, nothing I have ever felt or seen would make me strip nakid and play in a highway. then, you would think someone would see a nakid girl playing on a highway, no charges for the driver?

She [may have been kidnapped] and dropped off the side of the highway by the bastard. The girl probably tried to flag down a car to help her but it was dark and thats how she got it. I HIGHLY doubt mushrooms would make her do that.

there have been plenty of people that have been so ego disolved that they realize clothes are totaly pointless, and strip down and feel free(it really feels fucking AWESOME, try it...by yourself of course, or with your old lady who is partaking too, it is very liberating if you let go of the ego's guilt that drives you to wear clothes in the first place, i am very serious, fucking get naked next time you shroom, just dont be in public of course). divinely you realize clothes are restricting your freedom. we only wear them out of shame(ego) and cuz of society making us. otherwise what? we are ANIMALS, do we make all the other animals wear "clothes"? no. its part of society. try and put a lil doggy sweater on a dog. observe. the dog is like WTF is this shit? get this fucking thing off of me, and it frantically will try to get it off. because they are uncomfortable to them. and if yoru shroomin balls, you might be like fuck this, just like the dog.

A third teenager was charged Friday in the drug-related death of a 17-year-old Newbury Park girl, with prosecutors insisting they would hold responsible anyone who contributed to her death.
Jonathan Martinez, 19, of Camarillo, pleaded not guilty in Ventura County Superior Court to charges of involuntary manslaughter and giving drugs to a minor in connection with the death of Victoria "Tia" Nugent. Martinez was being held at the Ventura County Main Jail on $50,000 bail. A preliminary hearing was set for Sept. 22.
Last week, Brian Mitchell and Alissa Ruef, both 18 and of Thousand Oaks, were charged with giving drugs to a minor. Mitchell also was charged with involuntary manslaughter. He was being held at Ventura County Jail on $55,000 bail. Ruef posted bail late last week.
Senior Deputy District Attorney Ron Carpenter, who is prosecuting Martinez, said adults and youths could take something away from this case.
"If one message goes out to teens and adults, it is that we do not take care of our friends like that," he said. "We do not help our friends become under the influence. Friends are supposed to help friends, not put them into harm's way."
The three teenagers are accused of supplying psychedelic mushrooms to Nugent, who died when she was struck by a car Aug. 15 while walking naked on Highway 101 near Wendy Drive. The Van Nuys man whose car struck Nugent was not cited.
Nugent had gone to a party the night before and returned home with friends by 1 a.m., Nugent's mother said during an interview last month. Nugent apparently left her home during the night and was walking alone on the highway about 3 a.m. when she was struck. It was unclear when Nugent had taken the mushrooms.
Although toxicology results are pending, prosecutors said they were confident Nugent was under the influence of psychedelic mushrooms when she died. They allege Martinez, Mitchell and Ruef gave Nugent the drug the night before she died.

The details leading up to Nugent's death remain under investigation by the Ventura County Sheriff's Department, spokesman Eric Nishimoto said. It was unclear whether more arrests would be made.
"We're making every effort to find all the parties responsible for Tia's death," Nishimoto said.
Nugent, a recent graduate of Newbury Park High School who would have turned 18 this month, had been scheduled to start school at San Diego State University this fall.
The fact that Nugent was almost 18 when she died is irrelevant, Carpenter said.
"It has no bearing at all," he said. "The law does not say, 'A minor who was about to turn 18.' "
Nugent's family declined to comment on the arrests. Family friend Kathy Flanagan, whose family considered Nugent an "honorary Flanagan," also declined to comment other than to say youths in Newbury Park need a safe place to spend their time.
"If you talk to these young people, they'll tell you it's boring and there's no place to go," she said. "They need somewhere they can go, someplace they can hang out that is a more safe environment, where you're not going to be exposed to those things that aren't safe for you."

her parents should be charged then too, for letting her leave the house.

I have some issues with this... first off, giving mushrooms to a minor is a serious crime... the only way the cops could have found out about that part was from her friend's statements, so the kids who got arrested made two big mistakes- 1- they gave drugs to a minor, and failed to supervise her properly while she was tripping, which is just plain wrong, and 2- they told someone about it, it might even have been them who told the cops "yeah, we gave her mushrooms"
moral of the story- giving powerful psychedelics to people with young fragile minds is dangerous and should not be done without proper supervision, and , when someone you gave drugs to od's or trips out and gets herself hit by a car, leave town immediately, and don't answer any questions from nobody.
as for the idea of the whole story being preposterous, i personally know people who have taken too many mushrooms, stripped off all their clothes, and went wandering off thinking they were on a beach or somewhere else completely from where they really were.

Im not trying to be a dick but...
Giving pf jars to people are not supervising them is the same thing pretty much. U are giving them to the person in hope they will be responsible. U are giving them to them for mycological reasons and not to be injested... U wouldnt want to be charged for contributing jars just the same as them contributing mushrooms. If thats truely how u believe i think u should reconsider what ur doing here selling what ur selling. Im not saying what ur doing is bad. im saying u may be to blinded by the money to realize u are going completely against what u stand for. This is going off what u have just posted.

Also what i hate in the artical is the word "Drug" i mean come on. Why when they quote these people they are like "drugs are bad" blah blah blah. Then they go home and pop some asprin to get rid of a headache or maybe some opiate to kill some cronic pain or something. Drugs are drugs.

I think its way more likely to get real drunk and stumble onto a highway than eating a bunch of mushrooms and stumble onto a highway. Id rather go stare and a friggen tree.
I dont think this article will have a major impact against mushrooms personally. Theres way more worse things out there popping up everyday. Good job finding it though motaman.

A Ventura County teenager charged in the bizarre death of a Newbury Park girl admitted Friday that he gave the girl hallucinogenic mushrooms hours before she was struck and killed by a car as she wandered naked along a local highway.
Jonathan "J.J." Martinez, 19, of Camarillo pleaded guilty to one count of furnishing a controlled substance to a minor at a hearing in Ventura County Superior Court. He faces a maximum of nine years in prison at a sentencing hearing set for Dec. 1.
In exchange for Martinez's plea, the Ventura County District Attorney has agreed to drop a second count, involuntary manslaughter. That charge carries a maximum four-year prison term.
Outside court, prosecutor Ryan Wright said the agreement was "consistent with office policy."
"We took a plea to the most serious charge," he said. "Despite the way it sounds, furnishing to a minor is the most serious charge."
Martinez remains in jail. His attorney, Harrison Gavin Long, was unavailable for comment after the hearing Friday.
Wright declined to discuss plea negotiations, but said defendants generally accept plea agreements as a way to argue for a less severe punishment. State law allows judges to use discretion when a defendant admits guilt, Wright said.
Martinez's sentence could range from probation and time in county jail to nine years in prison.
Martinez is one of three teenagers charged with giving hallucinogenic mushrooms to Victoria "Tia" Nugent, 17, who died Aug. 15 after her middle-of-the-night walk on Highway 101 south of Wendy Drive.
Search warrants made public last month revealed that Martinez and his friend Brian Mitchell met up with Nugent and her friend Alissa Ruef late Aug. 14 in order to eat mushrooms purchased by Martinez. By 3 a.m. the next day, Nugent had wandered naked onto the highway.
Martinez, along with Mitchell and Ruef, both 18 and of Thousand Oaks, were charged with furnishing drugs to Nugent. Martinez and Mitchell were also charged with involuntary manslaughter.
Ruef, who declined to comment for this report, and Mitchell, who remains in jail, are expected to appear in court Nov. 18.
Reached by phone late Friday, the defendant's sister, Samantha Martinez, said she is relieved the manslaughter charges against her brother will be dropped. She acknowledged, however, the matter is far from over.
"We'll be happy when he's home," the 18-year-old said.
She said many people have painted too negative a picture of her brother, whom she described as a hard-working student who made a bad decision. Her brother graduated from Hillcrest Christian School in Thousand Oaks last year, she said.
"He made a mistake and now he is suffering the consequences, but that is not all he did," she said. "He did a lot of good things."
Wright said Martinez did the right thing by pleading guilty Friday.
"That's commendable, that he was willing to step up and take responsibility," Wright said. "And I'm sure that's something the judge will take into consideration."

I first met this beautiful young woman that had SO much potential when I was interviewing her for a job. She was by no means the type of kid that I thought would ever be involved in dope use. I felt SO bad at the time of interviewing her that I was unable to hire her due to the fact that she was a minor. I later met her at my favorite movie theater were she was employed and assured her that I would gladly hire her as soon as she turned 18. I have interviewed hundreds of applicants in my management career and never met a girl so young that had such natural professional talent. At this point there is SO many things to blame but it will never bring her back. From the friends who gave her the dope or the friend who took her home and then snuck her back out and then let her run out of her house half naked and then eventually looked for her to no avail. To the poor soul who did not see her well enough to stop on time on the freeway. This is the ugly side of drug abuse.people die.good people. you can glamorize it all you want here but the fact remains dope kills.mushrooms kill.I have had my experiences with shrooms in my younger days and quickly realized the potential of danger. Unlike other drugs you can so easily believe you are walking on a sandy nude beach and not realize you are walking naked down the middle of the freeway. To Tia's Friends. I hope to god you don't let her death be in vein. To her buddies that doped her up and did not fully take the responsibility to make sure she does not have a bad trip. May the courts and mostly God have mercy on your souls. For you destroyed a beautiful person.
