That depends on the circumstances.  The test is whether there was an intent to deceive and make someone believe that you're a licensed attorney giving sound advice.  There's also a reasonable person test at play.  Would a reasonable person believe, under the circumstances, that he/she was getting legal advice from a licensed attorney?

Again, it takes a deception coupled with an attempt to get someone else to act on that deception.  If you want to be an attorney for purposes of chatting in a bar about nonsense, have at it.

dont you get background checks over there when you apply for a job? or do you just turn up on your first day like 'yeah mate im a brain surgeon, pass me the chisel thingy'

* in the UK impersonating a lawyer would carry a criminal charge , it sounds a bit different in the U.S but im guessing the same rule would apply in some fashion - im taking it as to get the job she applied for she needed to be legally able to represent someone (you call it bar registered over there iirc )

as someone that works in a credential-focused industry, it's really hard for me to comprehend making the effort to get into a decent law school, graduate with a law degree, then take the bar and fall flat on your face and just give up.  I get that the bar is difficult, but that's why you do the work.  in the context of life's challenges, passing an exam you're educated for and whose subject matter isn't a black box is among the the easier challenges to overcome.  it's a lot of work, but so is practicing law.

It's actually quite easy to pass the bar if you go to an accredited law school.

I don't really know what's going on anymore.  I work in non-gov infosec and I have to file my credentials with the feds yearly and redo my background checks every something years.  I can (and often am) be called at any moment and have 60 min to report for breathalyzer, 10 panel urinalysis, and hair follicle test.  then I hear about cia cats being arrested after being caught stealing gold bars and lo and behold their entirely employment or background history was bullshit and no one found it until they were looking at them in a criminal prosecutorial context. 

the world feels pretty goddamn upside down to me at the moment and I don't think I'm alone.
