North Dakota governor calls special session to ban kratom 🌿

Gov. Kelly Armstrong said the topic can't wait for the regular session.

BISMARCK — North Dakota lawmakers will head back to Bismarck in an attempt to ban a plant that officials say is deadly when abused.

Gov. Kelly Armstrong on Monday, Aug. 3, called a special session to address kratom, a leafy plant that causes sedative effects when taken in high doses, according to the U.S. Drug Enforcement Administration. Legislators will convene Sept. 2 at the state Capitol, Armstrong said during the press conference.

“North Dakotans are overdosing and dying from a product you can buy off the shelf in a convenience store without any regulations or age requirement,” he said.

Armstrong also signed executive orders that ban kratom for 30 days starting 5 p.m. Wednesday. Armstrong noted the U.S. Drug Enforcement Administration recently listed kratom 7-hydroxymitagynine, or 7-OH, as a Schedule 1 controlled substance. 7-OH is a psychoactive ingredient in kratom, according to the DEA.

Schedule 1 drugs have no accepted medical use, pose a high potential for abuse and are illegal, the DEA said.

Kratom is little known and new in North Dakota. The plant is typically crushed up and consumed as pills or tea. In low doses, kratom acts as a stimulant, according to the DEA.

The plant is unregulated in North Dakota, Armstrong said.

“Right now, it is the Wild West when it comes to kratom and 7-OH sales in North Dakota,” he said.

Attorney General Drew Wrigley and others joined Armstrong during the press conference. Wrigley called kratom a “public health crisis” and said the plant is harming, addicting and killing North Dakotans.

Ten states in the U.S. have banned kratom, Armstrong said. The North Dakota Legislature attempted to ban the plant during the 2025 legislative session, but it failed in the House 15-77.

Armstrong attributed that to legislators not knowing the effects of the drug.

The Legislature is due back in January for its 70th regular session. Laws made in the 2027 legislative session won’t go into effect until a year from now, Armstrong noted.

“This is quite frankly too important to wait that long,” Armstrong said.
